Sick note - when am due back in work?

My partner was signed off for 2 weeks by her GP on 09/08/2011, a tuesday. For the Monday and the Tuesday of the appointment she called in sick....which i assume to be classed as a self-cert.

My question is when does the doctors note run out and she is due back in work?

We both assumed that she would be due back in on the Wednesday(24/08/2011), but when her boss called her today to see how she was getting on he said she was due back on the Monday (22/08/2011).

Any ideas?

    If you receive a sick note on a Tuesday, starting that day, then you are due back on the Tuesday - not Monday or Wednesday. The 14 days includes the Tuesday. But if you are fit enough to return on Monday, there is nothing to stop you returning.

    Actually if the sick note was for 2 weeks and signed by the doctor on Tues the 9th, it would cover the period Tuesday 9th to Monday 22nd inclusive. So due back to work on Tues 23rd.

    The sick note cannot cover Monday 8th as you didn't see the doctor that day so that is self-certified.

    I agree - it's the Tuesday.

    2 complete weeks/14 days. You don't get 3 Tuesdays in a 14 day period :)

    Only if the employer allows it though (could be insurance problems etc) or the Dr amends the fit note to say it is ok.

    No - this is a myth. A fit note (or in old terms, a sick note) is advice - not instruction. If an employer believes that someone should not have returned to work - with or without a fit note - then they should get independant medical opinion on that.

    Yes - which is why there ought to be a medical assessment if the employer has any concerns at all. Whether or not someone has been off sick. Ever heard of employees who refuse to go off sick? The same applies. But most people off sick are off for short term things that get cured easy, and there is no reason why it takes two weeks - or more - or less. It's called both parties exercising common sense.

    It depends what date is on the sick note. Two weeks can be 14 days or it could be the rest of that week and next week but if the employer says she's due back in on Monday 22nd there's a good chance he's reading it off the sick note.

    This is based on the amount of sick notes i've had to hand in in the past & trust me, for about 3 years i was handing a lot (of genuine) in.

    But as said, it depends on what date was on the note. This is based on the assumption that it was signed on Tues 9th, so you'd be due back Tues 23rd.


    But it sounds like the gaffer would be ready to give a bit of grief for not returning on the Monday, so here's awaiting your next thread.

    i think it's more to do with what was meant by what was said... Just because the Dr may have said 'i'll sign you off for two weeks', it doesn't mean it's two full weeks / 14 days.
