Getting harrassed about an old 3 mobile account

I'm not sure if this is the correct place to post this but my wife had a phone account with 3 in 2005 or 2006. The account was cancelled and 3 agreed to write off the balance of £250(ish) due to the issues she was having with her handset. I have this in writing from 3.

For the last 2 years or more she has been getting a letter every other month, at the least, from either Lowells or Red and various other places saying you need to pay this outstanding amount or else.

At first I replied sending a copy of 3's letter writing off the balance, but it has made no difference in the letters arriving, so I've given up on even responding to them.

Can anyone please point me in the direction of a letter to send back or somewhere I can complain to about this.

I assume that their tactic of threatening to send someone round about the account is purely that, just a threat to try and get people to pay up. That in itself !!!!es me off and I guess that tactic may work with some people, but I know my rights and that doesnt worry me at all. The amount of letters I've had with no one ever turning up I think proves its just talk. But its getting annoying now the amount of demands coming through.

  • You should send a copy of the letter you sent last time with a new letter detailing your complaint. They should have a complaints department, send it royal mail special delivery so you know they got it.

Ask for a response from one one in charge.

Failing this its probably worth u getting your own solicitor involved and do them for harassment.

Its the OFT you need to complain to. They are clearly in breach of debt collection guidelines - see here - OFT Debt Collection & letter Guidance - READ IF YOU ARE BEING HASSLED UNFAIRLY

Normally, I would agree, but in this case, since the debt is from 2005, it's clearly statute barred anyway. I'd just send them another letter with a final warning and the 'write-off' letter from 3 appended. I would copy that to OFT and report them. End of. You dont owe the money and you are not obliged to pay it, and even if you were, its barred by now.

No, it really isnt. You can threaten this, but if you were so stupid as to go down this route, you would end up paying through the nose for something you could have done in the first place....which is to tell them to get knotted.

    In short, ignore and shred.
