The law he signed says that no one should be killed except by execution of law. Which basically means, after a fair trial. I don't think the fundamentals have changed since then.
The state shouldn't kill someone for an offense unless that is the punishment proscribed by law; no one should be killed unless they have had a fair trial. The only exceptions are during war, or as reasonable defense of life or property.
If someone is running at you with an axe, you can shoot them.

I'm not sure but if it was up to me it would be shoot 2 for £40 or shoot 2 and bag the 3rd one for free.
