Suing is a civil matter. A tribuneral carries severe consequences.
What do you base this statement on exactly?
The consequences of a tribunal are no more severe than a civil court - indeed as the amount of compensation available in a civil court is unlimited, I would say the opposite is true.0 -
I got 2 payslips, 1 for the 2 days and one for the 2 days and the 5 days for the following week. The first payslip for the 2 days had tax and ni come off it. Then the next one, the 2 days and the 5 days were taxed and nied. They then took the net amount they paid me from the first week for the 2 days off the net for the 5 and 2 days together.
Then that's correct. For ease of calculation, let's assume you earn £50 a day, with figures rounded.
If they'd done it separately:
Payslip 1
2 days: £100
After tax (20%) and NI (12%): £68
Payslip 2
5 days: £250
After tax and NI: £170
TOTAL for both payslips SHOULD be: £238
What they did:
Payslip 1
2 days: £100
After tax (20%) and NI (12%): £68
Payslip 2
2 + 5 days: £350
After tax and NI: £238
MINUS the first payslip: £170 (£238 net minus £68 net)
TOTAL for both payslips IS: £238
This isn't about getting numbers correcting, but pointing out that the principle of what they've done is correct. You may owe them an apology...

Im not self employed or under an umbrella company. They tried to push going onto an umbrella onto me.

I havent got the payslips infront of me but roughly it went like this..
payslip 1: gross for 2 days £190
tax and ni: around £9 tax and 6 ni
net: £174
payslip 2: £580 for 2 days and 5 days together
tax and ni: £87 tax and £52 ni
net: £440 minus the £174 from previous week = £266 for a 60 hour week??
are you saying this is right?
to put it briefly this is how I think it should have went..
first week same as above..£190, £174 net
second week £406, £321 net
means that i was underpaid by around £55, all because they tried to put me onto an umbrella company slyly without my permission!0
