We took out a loan 3 years ago for a car. In June we went to the bank and they offered us a better loan. So we phoned up to pay off the car loan. A D/D for the car loan went out 1st June we asked for a settlement amount on the 6th June we paid the figure given which we paid over the phone that day. They called today to say we missed the last direct debit (which we didn't I have checked the statements) and if we don't pay it by friday they will add an admin charge.
So can they persue us for this amount they say we owe? And how can we owe it if we haven't missed a payment and we paid in full the final figure they gave us.

Are you able to provide them with proof of the payment? It could be the payment went out of your account but something went wrong with the payment into theirs, which they will obviously need to look into. But it doesn't surprise me if they are saying it's just simply not been paid even if that has happened, as imagine how many people say they have paid but haven't. ;)

We paid by direct debit every month and i can see the payment went out on the 1st. Then paid in full on the 6th with the figure they gave us on the 6th. We have proof from out bank statement.

What exactly did the settlement figure/notice show. When I've done this in the past it's generally said that the next DD (i.e. in your case on the 1st of following month) still needs to be paid as well as the settlement figure - i.e. pay both over phone and cancel DD or pay settlement and wait for next DD to clear balance.

Do the numbers stack up or do you think you're overcharged ?

Really? The trasation was done over the phone we never had anything in writing. They told us the figure and we paid it there and then. We were under the impression that the payment would go out on the 1st then the final settlement figure would be just that and that it would be paid off with nothing more to pay.

Yes really - with both Halifax and Nationwide.

Have you received a final statement from them and balanced it ?
