***ADVICE NEEDED*** Welcome finance NIGHTMARE

Hi all...Looking for some advice...I'll start from the beginning:

My Husband lost his job in Jan this year and was off work for 7 weeks till he found a new job...we used savings to pay prioity debts then luckily he found another job in march but it was about 15k less a year then his old job...

we knew it'd be a struggle( but its was a job) but tried our hardest to pay everything...we are approx £350 a month short every month...we put the house up for sale even tho the sale price means we're in negative equity hoping welcome would turned what was left over after paying everything into a non secured loan...the house hasn't sold (not had 1 viewing) and its been up for 4 months now so we seeked advise from CAB and they advised my hubby to file for bankrupty so we didn't pay the mortgage or loans last month and paid to go bankrupt.

Well my hubby got his application refused by the judge (which i am grateful for now) cos the house is in negative equity and the recievers wont touch the house so we'll still be left with it and the amount of unsecured debt is less then 4K so we spoke to the money advice centre at the court who advised us to let the house get repossed then if theres not enough to pay everything after the bank has sold the house he could try again for bankrupty as long as it was more then 15K...fair enough but we've read the welcome loan details and they can send b a i l i f f s round which is really worrying me..
Welcome are currently ringing my mobile and work phone 10+ times a day at the min cos of the missed payments, Ive spoke to a lady from my local branch who at first was ok and said she's lower my payments, they know the house is up for sale and rings to find out if we've sold it or had any interest in it and now we've missed 2 payments now she's ringing my work phone more which i am not allowed personal calls..!! Is there anything i can to make these stop?..
I know we're in the wrong but the stress from Welcome is awful...they're awful on the phone.

can Welcome put a attachement if earnings on our wages?! the mortgage and top up mortgage is in my hubbys name but the welcome (secured) loan is in both?! we both work..Hubby full time...me part time as we have a 18 month old...ANY advice would be grateful...thank u Zoe

    Yep, just because you owe them it doesn't give them a right to harrass you. They can still communicate with you - just in writing.

    I would throw that phone sim in the bin and cancel the contract (if you can).

    Get a free PAYG sim (most companies will give you one for nothing) and use the same phone with a new sim and number.
    You simply won't stop the calls in the short term.

    Not much you can do about the calls to work, you did give them the number after all (appreciate you had to though).

    you only have £4k unsecured, may seem a lot to you but in general, that is nothing. Ring the CCCS about the unsecured debts and try to reduce the payments to those.

    Your credit is already shot so it make no sense to keep repaying unsecured debts when you have secured debts to focus on.

    If you can make token payments to the unsecured debts, it may free up enough money to concentrate on the secured ones.

    Either way, the unsecured debts should be put aside for now with £1 token payments.
  • I can't cancel my contract but ringing me and work phone 10+ everyday is a bit excessive tho.I've printed the template above to help solve the phone calls..I know we're in the wrong but still and as for unsecured debt we're paying as much as we can now to try and get it paid off.im just worried about welcome sending bailiffs round

    Welcome Finance and its parent firm Cattles are basically bust anyway, I would offer them something like 30% of the debt and see what they say.

    Seriously, i would try that if you have it as they are desperate after lending soooo much cash to dodgy people.

    hiya,

    ive never paid my welcome loan for a year and a half now and have only had one visit from them when the payment first stoped. it wasnt a bailiff as such just one of there emplyees asking me to make the payments again. they are probs just saying that to scare you and it is only court bailiffs that can come into your house, others are not allowed to, anyway, when he came out he just asked me to start paying again, i told him i could not afford to as i had just lost my job and couldnt afford anything full stop!!! he said ok and that was it, they still send me statements out each month but apart from that nothing! so to be honest i wouldnt worry about as much as you are, whats the worst that could happen? take you to court and give you a ccj, where you tell the judge what payment you can afford and they usually agee to it, obviously this is not the best option but at the minute what other options do you have! if you cant afford topay at the min dont let it get you down so much.
  • they cant send a bailiff round without going through the courts first, so you will get a lot of time, and unless they turn up with a warrant from the court, just dont let them in the house.
