How to take agent to court pls?

We have used an agent who has added spurious fees which we have not agreed on. Basically the tenant has paid the agent rent and deposit and agent has taken off what they feel like and sent the rest of money to us.

We have disputed the charges with agent but they are very unscrupulous. We want to take the agent to court to reclaim the money - £205. Can someone kindly tell us how we go about doing this please? Much obliged for your advice.

Lesson 1: selecting a good agent is as important as selecting a good tenant.

    Lesson over!

Which country are you in? Scotland is different....

    Small Claims Court here.

    Online claims here.

    Advice here.

Or get help from your landlords association, Landlordzone, Landlord Law

If you don't have Power of Attorny your dad will have to bring the action and argue the case, which with alzheimers might be challanging!

Who instructed the agent? You? Under what authority? It's going to make your case more difficult!

The OP has another thread; replying here to try to keep stuff in one place.

I think your situation could get very complicated very quickly - and for £205 you might be better off putting it down to experience.

Who signed the contract with the agent? You, or your dad? Did your dad have capacity at the time (either to sign himself or to authorise you to sign)?

If your dad still has capacity to appoint somebody as attorney, you need to try to sort that out as a priority. If he doesn't, you still need to sort something out - you can't just go renting out other people's properties without permission. Age UK or Alzheimer's Society might be able to give you some useful pointers.

Where is this house? Foreclosure and the date format suggests that it might not be in the UK.

Consider your agent's financial standing. If you found something wrong, then, contact a lawyer.

Russell, this is a UK-based forum. Thanks for dropping by, but USA-specific advice may not be appropriate here.
