    did you sort your own DMP out or did you go though one of the co like payplan or cccs? I've gone through CCCS so not paying them isn't really an option. If they carry on phoning all the time I'll give ccccs a call and see what they suggest.
  • I run my own DMP. Hopefully CCCS will be able to have a word with them, remember you don't have to talk to them or even answer the phone. Just stay strong you won't be in this situation forever, it just feels that way sometimes.

    Dear Sir/Madam,
    (Reference: XXXXXXXXXXX)

    Despite my previous letter regarding ANY communication from your company, which stated that I require ALL communications in writing, your telephone calls continue. You have contacted on several occasions over this past week my parents address. I have not lived at my parents address for several years and I regard this communication as not only a breach of the Administration of Just Act 1970 but a potential breach of Data Protection Laws.

    This behaviour constitutes harassment; the letter stated quite clearly to you that I require ALL communications in writing for future Court use. Do not telephone me again - remove any telephone numbers you hold for me from your systems.

    Your telephone calls are in breach of the Office of Fair Trading guidelines. If you continue with them after the receipt of this letter an official complaint, together with a log recording the times and frequency of the calls will be passed both to that office and to the Trading Standards office. For your information note that ALL telephone calls are taped.

    This type of debt collection method is contrary to the ‘Administration of Justice Act 1970’ in that it is intended to cause alarm and distress to the recipient. Your methods will not be tolerated. A formal complaint, containing copies of all correspondence including yours, will be submitted to the relevant authorities if your calls continue. This will be relevant to questions of your fitness to hold a licence under the Consumer Credit Act, whether or not it results in a prosecution.

    Take further note that continued telephone calls after the receipt of a request not to call may constitute a criminal offence under Section 127 of the Communications Act 2003.

    Communicate in writing and ONLY in writing, your telephone calls will NOT be answered.

    HOWEVER, CALLS WILL TRIGGER COMPLAINTS TO THE REGULATORY BODIES.

    I trust that I have made myself understood on this matter.

    Modify that to suit your needs and send them that. Then just ignore their calls as best as possible and if they continue to call after say 7 days answer the phone and tell them that they are in breach of the Administration of Justice Act 1970 and you are going to report them to the FSA.

    Also, its a breach of regulations to continue to contact you even though you have informed them that a third party is managing your DMP. They have to ensure that they only contact your third party from now on in.

    One of my creditors is halifax, when i first started out on my dmp, i would just say the same thing each time they phoned.

    "I am a client of ( name of dmp) my referance number is ?????? and there phone number is ???? ????, they are dealing with this account on my behalf, please phone them and speak to them."

    I would talk over the top of the person at the other end and them just hang up, it didnt take them long to start calling the dmp instead of me.

    I wouldn't mind as much if it could be a quick, talk to the cccs please, it's the fact you have to go through the whole stupid automated system before you get to speak to anyone, and if you put down the phone before you have managed to speak to a real person the computer just keeps calling you back :mad:

    Just hang up, and keep hanging up, it soon makes them realise you will only talk to a real person!!

    Also as your phone provider to not except withheld numbers, a free service and nearly all creditors and automated calls are withheld.
    Like magic they are gone!!

  • I always ignore the Halifax number (ends in 4392?) as I've told them countless times that I've been in a DMP for three/four months!!! I also don't answer any 'Witheld' or 'Unknown' numbers, as they're generally creditors. I'm fuming today though, had a call at work that went to my direct line, and it was someone from blah blah finance.

    I was like 'Yes, you've called me at work, don't do it again.
    She still kept asking - about three times - if I could just confirm some security details, so I just hung up on her.

    Grrrrrrrrrrrrr
    This is the worst bit about being in a DMP, the damn calls - they're aware of my situation, and until I win the Lottery (which is difficult as I don't play it), then my circumstances aren't going to change in the near future!!! Nrrrrrrrgggggg

    The calls should stop within 5 weeks of being on a dmp, they soon realise if you say the same thing each and every time they ring, that there is no point speaking to you.

    Halifax fav was we cant speak to your dmp as its your account, i just repeated the ref no and phone no for dmp and hung up, 5 weeks later no calls, and its been that way ever since.

    lol yeah they tried that one with me yesterday when I said they would be hearing from cccs in due course, I just lol and said, yes CCCS told me you would try and say that, which is why I have already sent you a letter of authorisation for you to deal with them about my account and halifax is not allowed to ignore that authorisation. She soon changed her mind about not speaking to them.

    They were phoning pretty much none stop yesterday so in the end I actually answered once and spoke to a total idiot who was so rude. I told him the situation and he tried the whole "we don't deal with cccs" I told him that a payment would be with them on 25th of the month and asked for the calls to stop. He said they would but a block on the calls for 10 days to allow for the cccs paperwork to go through (so that will be the paperwork from the people they don't deal with then) but if it wasn't settled by then the calls would start again.

    I called the cccs and the lady I spoke to there LOL when I told her what idiot from halifax had said, she she told me that they (halifax) have already received my SOA and proposal as they don't send them in the post it's all done electronically. She said if they start calling again just to ignore the phonecalls.

    8.32am guess who starts calling again, so far today i've had a phone call on my mobile every 15 mins or so and on my house phone once an hour. So much for stopping the calls for 10 days.
