Hi,

I just received a letter from Lowell asking me for £3374.. I was shocked as I don't understand where it came from.. they said it was from a Lloyds TSB credit card in September 2007 (my date of birth is 17/10/1988) that they just brought.

I have never had a credit card, certainly not for that sort of amount! have a Lloyds TSB account but it's just a debit classic account, and have had it for almost 8 years.

I'm on benefits, income support and disability and was wondering what advise you can give me as due to my disability I worry alot and have depression... and them sending me letters demanding money doesn't help :(

Could it be possible someone used my details when I moved address?

What would you advise me to do? I don't want them chasing me for money but if I get bullied to acknowledge the debt by offering a payment for them to stop harassing me it probably won't help either... :(

Thanks for any advice x

It could be someone using your details, but my guess would be it is another person with the same name as you but not connected to you.

Start by sending them the prove it letter - http://forums.moneysavingexpert.com/showpost.php?p=11570893&postcount=2

But they said it was from a address that I lived at when I rang them over the phone.. or is it still possible it's someone with the same name?

Is there anyway to freeze it? I don't want to be bullied into offering a payment just for them to leave me alone.. :(

Send the prove it letter that Tixy linked to. That requires them to explain why they think it is your debt.

The chances are thety will write back and say it has nothing to do with you.

DON'T negotiate with them by 'phone - do it all in writing. And if they call you, tell them to put it in writing.

Well they (or a previous debt collector) could have incorrectly linked it to your address in error because they know someone with the name lived there or it could be fraud.
When did you move out of that property?

Did they say if Sep 07 was the default date or date account was opened?

Habe you checked your credit files?

Best not to call lowell but to do everything in writiing to you have a record.

I rang them up and asked for proof.

They said they will freeze it until then.

    What's the next step now?

Also can someone answer me what the minimum payment is that a debt company would accept for someone on benefits and income support?

I know that and I hope I don't have to pay nothing, but for my other debts I have I was just wondering what is the minimum monthly payment they have to accept with someone on income support etc?

benefits are the minimum you need to live on. none of them should be used to pay debts.

if you want to pay something then pay £1 per month

pressurising you to pay more would be against oft rules
