NDR Money advice please

Hi all

I am doing this for a friend who does not have access to the net and I have searched the forums and read most of the NDR threads, but dont see any answers to help with my query.

What is the best way to deal with this company when :-

They make regular payments they can afford only to be told its not enough and incur the usual £12 Charges each month.

She does not deal by phone, only by letter and has asked them to take her to court if its not good enough, but they wont.

She owes around £1100 which I think was originally to Marshall Ward and it goes back 5+ years.

She is tired of trying to lower this debt and it never being good enough.

Would ceasing the payments altogether be a good or bad thing and allowing them to take her to court?

Please can someone enlighten me the best action to take?

Many thanks in advance

Chooch

    Hi there,

Good to ask NDR for a copy of the credit agreement for the account.

Send them a £1 postal order/cheque and send recorded, as that is the only way you will get a response.

If they don't have one/one was never signed, they will start to listen a bit more to what you offer, they did with me. They upped the amount so I complained that they never replied to my letters and they accepted it after the complaint and agreed to freeze the £12 charges as long as the payment I offered is made on time.

How old is the account and did they sign an agreement?

Do you mean a credit agreement with the catalogue or with NDR?

The catalogue account is 5 yrs old.. 2 years repaying catalogue and 3 years paying NDR.

They have no recollection of Marshall Ward notifying them of NDR taking over the account. They were repaying £50 a month to catalogue and circumstances changed and they could only afford 25 and that is when it was passed to NDR.

    Thank you

    Hi

Ndr are littlewoods/very etc. Internal collections department of shop direct group. So ask ndr for it and you will probably get a reply from shop direct, I did.

Your friends payment seems reasonable to me. I pay £50 per 4 weeks and owe £3k

Ask for signed agreement and see what turns up. Send recorded.

    Good luck

You need to pay £1 for a copy of your credit report as per the consumer credit act.

If you search for cca request on here you will see example letters

They may try and fob you off with something other than what they should send you so please post when they send something and me/someone else will help you figure it out

    Thanks again Bunny

Yeah I sussed it out and found a template letter along with what they might send ( a standardised credit agreement not signed by the party involved) so forearmed is forewarned.

Thanks again.. very very much appreciated
