Defaults removed?!?!

Ok, so been a couple of months since I contacted Lowell regarding Shop Direct, 3 mobile and 02. National Debtline said my first port of call was to ask for my debt to be wiped and to send evidence that I was experiencing mental illness around the time of accumulating the debt and that I still see someone about it etc. And that I am expecting my first child and going to be a single parent. I didn't expect yes's but was told it was the first step, if they said no I would be making £1 token payments. But that there was no harm in asking. I really didn't expect to get a yes...So these are the 3 letters in order. I am a BIT confused by the 2nd as it doesn't say that the debt isn't going to be pursued just that the files are closed....the third one says my defaults for ALL 3 are to be removed (I had asked, taking the mick a bit I guess!). Obviously they were never "incorrectly" recorded as I did default. So do you think its safe to mark the 3 and 02 debt as "cleared" on my snowball thing?
First letter from Lowell 13th June
confirmed Shop Direct weren't going to pursue me for the debt anymore
Second letter from Lowell 14th July
"We can confirm we have contacted the original creditors..[3 and 02]... and are please to advise you that our files have been closed and the accounts returned to them"
Third letter from Lowell 27th July
"We have noted your comments and can advise that all the relevant credit referencing agencies have been contacted to remove these incorrectly recored defaults from your credit file"

Sounds fairly promising so far - regarding the second letter you might find that 3 and 02 sell your debts on again to someone else. So I wouldn't count out hearing from them again in some form, if that does happen then you could certainly try the same letter again.

See my main concern regarding that is that if the defaults have been removed, surely they would be re-defaulted and that would be from a later date? Or should I expect to hear from 02 and 3 directly. I've emailed Lowell asking for some clarification howeverSounds fairly promising so far - regarding the second letter you might find that 3 and 02 sell your debts on again to someone else. Presumably the default dates were the date the phone companies had issued defaults? they should be the original creditors dates not the DCA. So if a new DCA took on the debt then they probably would put the entry back on your file and put on the old (original) default dates.
I'd make sure you keep a copy of your credit file showing the defaults as they are now in terms of the date. Then if any new DCA tries to put on a later default at some point you would be able to insist it is corrected to the original date (and have the proof which should make it easier).A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
I've sent off for my credit report so I will do that thank you!Presumably the default dates were the date the phone companies had issued defaults? they should be the original creditors dates not the DCA. Hi, I am hoping someone can help me… I recently obtained a copy of my credit file and realised that HSBC had issued a Default on it. I phoned up HSBC to dispute it and they agreed that it should be removed (the reason for it was because I do not have a debit card with HSBC and as their systems cannot accept payments from a debit card from another bank they passed me over to debt collectors - although they have phone records of me trying to make payments every month! - The debt agency fortunately could accept any banks debit card and the debt was cleared immediately)
Further to my conversation with HSBC they have issued a letter stating that the account is fully satisfied and that the Credit Rating Agencies were informed at the time, however, "it is not their Policy to remove any data on the Credit File" - at the time when the letter was produced I asked them to confirm that was all I needed as proof and was advised that the letter would be enough for the Credit Rating Agency to remove the Default.
I've now learnt that the only people that can remove the Default are HSBC!! So I just spoke to the Complains department who agreed to look into it but said that they would need proof of an "error" in order to have it removed and I am worried that the fact that their systems wouldn’t accept a Natwest debit card and the fact that I've been told by 2 HSBC employees that the letter would be substanstial isnt going to be enough.
I know a lot of people dispute their defaults because they never received the notice but has anyone had a case like this and won?
Would really appreciate any comments or templates I could use as I know I shouldn’t be doing all this over telephone conversations.
Many thanks0
