If a deposit was made, will that make me exempt from the Limitation act (1980)?
No. For two reasons.
1) It would already have been statute barred before that date. Once barred, a debt stays that way permanently. No matter what you then write or pay.
2) It is only payment of the debt by YOU that can prevent a debt being statute barred. (If within the 1st 6 years). A payment made by anyone else does not effect the legal standing of the debt.

Hi,
I'm looking for some help also.
I went to regional college between 2002 & 2003 and as far as i was aware my student fees were paid by the student loan company.
However i have received a letter from a debt collection agency today (first one ever received) stating that if i do not pay the £1125 in fees in the next seven days that they will instruct their client to take me to court to recover the monies.
First of all, as it is now 2011 and the course was in 2002/2003 then does this mean it comes under the terms of "statute barred".
Secondly i'm seriously freaking out about the whole thing and i'm wondering what will happen to me if the whole thing goes ahead. I dont have £1125 to pay upfront in 7 days nor will i have in the future. Money is extremely tight nowadays.
At the time i did apply for a student loan to pay my fees and therefore assumed that these were paid. Furthermore i don't understand why they would be chasing me for a debt that supposedly was not paid over 7 years ago. Plus i cant even contact the college that the debt is from to query this, but rather it has to be through this company "TNC".
Any help with this would be greatly appreciated.

Same advice as above really. Cease all communication with them except by post, send them the 'prove it' letter that fermi has posted within this thread and sit back to see the response.
Rules might be different for studying stuff, not sure, but if you send them that letter it would at least let you know where you stand, then come back here and make a new thread about it for advice on how best to deal with them.

Hi my partner received a letter stating he owed £1783 from his current account to Lloyds and it was now being passed to a debt agency, however he doesnt remember this debt and dont know when it was from, i have been with him for 3.5 yrs and know he hasnt got it whilst with me. what should i do about this? i would be really grateful for any information or any ideas?
