HELP!!.....Worried........

Hello all, can anybody please answer these!

1- when i do my "soa" do i have to do a household budget for the mth of what goes in the bank for my wife and myself, as i"m the one who might declare myself bankrupt and not her?, also is that the case for the courts?

2- I have being paying "greg pen" £100 mth for the last 2yrs, £86 a mth is set by the courts, i have missed decembers payment, and not going to be albe to pay januarys eitheir, i phoned "gp" and told them this and they said i would have too consider leaving there program if i cannot make the payments, ..what will the court and creditors do when they are told i cannot keep up with the payments?...

3- I know leaving "gp" will be the best thing, however i just don"t want the letters and the phone calls to start again , and will the court instruct BALLIFFS" to enter my rented house and collect items...thank u all..

    If your wife doesn't work then you would include all the household outgoings. Did GP recommend bankruptcy as the only route?

    You are on a DMP I take it?
    You can apply to the Court to have your payments rearranged so that you can afford the payments.

    The Court instructs bailiffs when a CCJ is ignored and all attempts at recovering the debts have failed. Don't worry about this, that has not happened yet.

    You must get the form to apply for a rearrangement - I think that the Court will have these. GP certainly should have them.

    Phone GP and tell them you need assistance with this. They should help you with the forms, etc.

    First of all try and calm down, I'm no expert about these matters but I should imagine somebody will be along soon who can help answer your queries.
    If I've got this right, are you planning on making yourself bankrupt? If so, make sure you get the right advice before you do. If you have had advice and are going ahead I'm pretty sure the bankruptcy will include all debts, including those payments set by the courts.

    Are the payments for the courts CCJ's - if so I'm sure you can apply to the court to have the payments adjusted, I think you have to call the court up and ask for forms - they will be able to point you in the right direction.

    Why aren't GP helping you sort this out, they should be and they should have the forms you need.

    As for the SOA, I think you need to post your details if you're wife is working and divide your outgoings between you. If your wife is not working just post a SOA with all your outgoings. You also need to do this if you make yourself bankrupt - they wont take her income into account I'm sure if the debts are only in your name.

    Theres a poster on here called Mike St Helens who, from what I've read is an expert on bankruptcy so it might be worth your while sending him a PM though I know he works shifts. (I'm not sure if I'm allowed to say this but worth a try anyway - sorry if I'm not).

    I'd give GP a call back and tell them you need some support and advice, they should be helping you, after all is that not what you are "paying" them for?

    can I ask why you chose GP? they are fee charging so a proportion of thier DMPs will go towards profiting them. You could run your DMP yourself, or use payplan or CCCS who are not fee charging.

    Could you do your SOA and lets have a see?

    £800 mth wages, out of that i pay

    £450 rent
    £22 mth phone (10 mth left)
    £150 mth petrol to get to work ( i work nights there are no buses)
    £100 gp
    £78 pound towards food bill for a family of 5

    my wife pays around £720 a mth out for car finance and bills, food, etc

    Have you thought about doing a DMP with free companies such as CCCS and Payplan? Then you would free up the charges you pay GP and have more to pay your creditors. They also work out an affordable budget for you to live on. Then you wouldn't have the pressure of the creditors calling etc. It might be worth a phone call although I think with payplan you have to make a minimum monthly payment of £100, somebody correct me if I'm wrong?????

    They may also be able to help with reducing your court payments too.

    Since your wife is working you cannot do an SoA this way.

    You can only claim half of the bills, or proportionately towards the bills.

    This applies whether you are doing a DMP/IVA/Bankruptcy.

    You need to sit down and work out an accurate SoA.

    Then take it from there. Trying to work out any payments without an accurate assessment of your own financial liabilities is suicide!
