Phoenix Commercial Collections...not mine

Hi guys,

Had a hand delivered letter a few weeks ago for my ex, regarding 2 unpaid parking tickets. I explained he no longer lived here and thought that was the end of it.

Yesterday, i get a notice before collection. Called the contact on the letter to confirm what I had told them previously, and was told because my ex and I are still married (on paper only) i was liable for the debt and they are still coming at 10am this morning!!!

Can they do this?

    I doubt it, but give National Debtline a call to check. Unless you were registered user of the car etc....

    They take calls from 9:30am on Saturdays.

    Are they definitely sending someone round rather than just phoning (calling)?

    They have said the debt can not be enforced against me and to ignore the door. I've been told to send a letter to the issuing authority of the parking tickets as soon as possible along with proof that I live alone.

    I feel a bit better now. Still shouldn't be a prisoner in my own home, but at least i know they can't come barging in.
  • Well I'm still waiting for them. All doors and windows are locked and every fan in the house is on overdrive. I'm melting here!!

    I'm wondering if the bailiff has realised she's screwed up by telling me I am liable for the debt this morning when according to National Debtline I clearly am not, and will just refer it back to base so to speak? National Debtline have advised me NOT to contact them again OR open the door to them so it's just a waiting game i guess.

    My friend has had dealings with these people before in much the same circumstances and they told her they can call up to 10pm at night. Well i'm afraid all they will get after 9pm is me zoned out by my sleeping tablets and a very large irate boxer dog who sleeps behind the front door :)
  • Does anyone know how up to date the certified bailiff register is? The bailiff calling at my door says she's from Pheonix but the register says Recovery and Enforcement Services (south west)

    I'm in the North West.
  • Well almost 10:15pm and still no sign of Pheonix. I can't spend another day keeping the patio doors locked, the dog isn't used to it and she's been driving me nuts. Guess i'll just have to take her out for the day tomorrow if it's not too hot.

    As national debtline say, you're not liable, however bailiffs know that they can BS people and get payment. It's obviously not right but for them its a percentage play. 10% of people pay off someone else's debt, 40% give them details of where to find the debtor, 1% of people complain and 49% get really worried but don't really *do* anything.

    Never did it that way myself but i know plenty who did.

    the register is not always 100/% accurate you need to phone the Ministry of Justice Public Register of bailiffslink3.gif on 020 3334 6355
    I am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

  • Been out most of the day but nothing behind the door when i got home and my son and his girlfriend have been home all day and they said no one has called.

    I'm just going to wait for a reply to my letters now and be careful who i open the door to.
  • Had a letter from Pheonix this morning. I am NOT going to be persued for this debt and they aknowledge that my ex is the debtor. (an appology might have been nice but i'll live with what i've got)
