Help! Credit score affected by late payments-Unfair!

Hi guys, I have a slightly unusual problem and I hope someone can give me some advice. It all started in early 2008 when I got a alliance and leicester current account in university. Due to illness, I forgot to cancel a standing order to a regualr saver and that breched my over draft limi, and I was hit with 2 charges, together with the amount taken by the standing order it was 267 pound. So when they called to inform me of this I complained but was willing to pay it off. When I went to the branch the lady there and the manger repeatly told me that there was a test case going through the high court and I should wait until that outcome is known before paying or not. I asked if that would affect my credit rating (I had over 20000 in saving with them and others so would have had no problem in paying it off) and was told no, as they can place my account under suspension and so when reported to credit agencies it would not count. Being young and stupid I accepted their word and waited for the court decision.

When the high court ruled I payed off the fulkl amount only to find that they have actually been reporting this account to the credit referencing agencies every month for 24 months!
Even during the period my account was in suspension! I also did call them during that period and was told there would be no point in paying until the high court case came through. The account has now been closed and now reads that in the last 36 months of activity 24 months shows 3 missed payments. So basically it shows 3,3,3,3, like this for 24 months! And most of this period the account was in suspension waiting for the high court case.

This has messed up my credit file as this is the only missed payments I have had! I am not sure what to do? Do you guys think I have a case? And has anyone has similar problems before? I really hope they do this, as you can appreciate this is stopping me from getting even alot of credit products.

Any advice would be helpful! I have substancial saving with santander, should I threaten to leave them if they do not alter the report to show the account was suspended? Should I threaten to sue or go to the ombudsmen?
