  • No disrespect to anyone who has posted answers to your query as you have been given excellent advice based on the information supplied but its not the whole story. We don't have the full ins & outs of your circumstances and rather than muddling along with bits of advice from people who don't know all the facts I think the best piece of advice was given to you by Clapton. Go and get some expert advice "phone CCCS/Payplan/nationaldebthelpline" asap and get this sorted out. I really feel for you and I think it must be really stressful worrying about the roof over your head. So take a deep breath & sort it out once and for all with the help of the experts.

    Couple of points

    1st consider asking for any charges to be refunded that would reduce the debt outstanding ( from what you say about the debt being doubled there must be charges)

    2nd write to Amex and send them a statement of income and expenditure and make a relistic offer of payment (only offer what you can really afford)

    3rd Ask for the original judgement to be set aside and have the case moved to your local county court. explain that you didn't attend as it was too far etc, also ask for the court to make a judgement for repayment based on your ability to repay and not add a charging order.

    I also agree seek advice from the professionals

    Hi hsgamboy Amex is one of the worst companies I'm afraid, I have been told that by various people and have personal experience of it as I owed them the least of all my debts but they have given and still are giving me the most hastle whilst I am slowly paying my debts off.

    As previous posters have said get some professional help I went to my local citizen advice centre and they offered to sort it out for me on my behalf so I would try that.

    I haven't been in the situation where they have put a charge on my house though and I owed far more than £4000 so DO get some professional advice and try to pay so much monthly.
