can my husbands debt mean they can take my our house?

Hi all

Firstly, thank you for your time in looking at this!

My husband purchased a flat when he was single for about 130k. The flat is now worth about 100k and has monthly mortgage of 750, plus 100 maintenance. He has tenant after tenant (rent is charged at 550 a month) who dont pay, go to prison, etc etc. He ends up borrowing money to pay the mortgage company. BTW, you could never get more than the 550 rent he charges.

He wants rid of the flat.

Even if he could take the hit and sell it cheap, he's stuck in a mortage until late next year with a 7,000 charge for breaking from it.

Our House:
My parents lent me the money to purchase a house. We both pay them back every month. When we got married and purchased the house, we signed a contract to say that I own 99% of the property and he owns 1%.

Now then, the tenants in the flat have not paid again, we have no money to pay that mortgage, we want to hand the keys back and walk away from it.

What are the repercussions? can they take our house away? his car? our stuff?

    hi kitty a couple of questions for you first, how much debt is likely to be left if he hands the flat back, does he have much other debt.

    Do you own the house outright with no mortgage, How much is it worth, how much did parents lend you, how long ago and how much are you paying them back

    he probably owes pretty much all the money back for his flat. he's been paying the mortgage for about 5 years and he's only just making a dent in the interest. Other debt: he has about 2-4 k on cards.

    I own the house outright, no mortgage. its worth 209k, my parent lent me all the money, we pay them 600.00 a month.

    okay, if he were to go bankrupt, they would probably stick to the agreement so they would want 1% of the value, i take it the loan to the parents is not secured on the house
