meal allowance for construction workers

I had claimed £12 per day for meals without the need for a receipt if I had been absent from home for more than twelve hours working on a construction site.
Now the tax person has claimed I am not entitled to that allowance as he is absent from home for up to twelve hours and he cannot claim.
Could someone please enlighten me?

Note in the link above where it states: where the worker has been away from his home/normal place of work
If where you are taking your meal is your normal place of work, you are not entitled to the allowance.0 -

The first post is confusing, are you talking about yourself or somebody else as you talk about I followed by he.
Are you employed by the construction company or are you a contractor to the company?
If you're an employee then you can't just claim lunches when you're at work because like Hammyman says, you'd have to eat any way. If you're a contractor to the company then you can claim tax relief on the £12 a day.0 -

I read the OP as meaning a person in HMRC said the OP could not claim because he (the HMRC employee) also was away from home for 12 hours but wasn't able to claim.0
