Application for redetermination

Hi all,

Please can someone help.

I recently had a county court claim against me from Lombard North Central who I owe £6282.49 and made an offer of payment of £1.00 a month which the court has accepted.

This is my first and only CCJ. I have other debtors which I have written to and made a token offer of payment for £1.00 all of which have accepted this and I am paying everybody on time and never miss a payment.

Today I have received a letter stating that Lombard North Central have entered an application for redetermination.

What does this mean? I really cannot afford to pay any more, the court can see this from the Income and Expenditure form I entered with this original claim. Can I now be ordered to pay more ? how can the claimant Lombard apply for this after the court has made a decision??

Is there anything I need to do....is there anything I can do to stop this. The claim has also been transferred to my local county court but I would really not want to appear in court in person....What can I do ?????

    I was in a very similar situation with MBNA so I'll try to help...basically they want the full amount - to essentially stop the payment & change it to "forthwith" inorder for them to get a charging order. A judge will say that the amount you owe will take 6283 months to pay off - so it's unrealistic Lombard will see their money again. Judges see to turn a blind eye when it comes to keeping up with the payments so creditors get their security - either the entire amount or a charging order. If you do own your home, is it jointly owned & is the debt in your sole name?

    No I do not own my own home. I have no assets and no money which is why I am paying everyone off at £1.00 a month.

    Do you know what happens if this is the case? Did MBNA increase your payments? Can they change it to forthwith if I don't have any assets?

    Ok - I'm not sure if I can help because my situation is slightly different...after my ccj, MBNA went to the court again & asked for a redetermination (like you) & they knew I owned a house & the judge agreed it to be changed to forthwith. As I was unable to pay, they were able to get an interim charging order then a charging order. I have read about attachment of earnings - where your payment can be withdrawn from your monthly pay cheque - they may decide to go for that through the courts. They also could make you bankrupt, but as you have few assets & can be costly to the creditor, that may not be an option.

    Hopefully someone will be popping in & can give better advice...or you can give CCCS a call & ask them as they see this all the time. Hth, SF x

    If you have no money to pay the debts, and it is going to take 500+ years to pay off the Lombard one. Then you might be better looking into bankrupcy...
