Can you get your hours increased then since shes left? You could ask for them to advertise 21 hours and give you the 31 hours?

No - she only did 16hrs so no point.
I have been to CAB today and rung ACAS to confirm what she said. As I have only been there just under a year I don't have a leg to stand on basically.They can do as they please regardless of my contract apparently
They know there are a stream of jobseekers to fill any places and though this doesn't please the customers - who like a familiar face - they don't seem to care about anyone or anything so long as the shops kept open.
Anyway thanks for the comments and interest, I am applying for new jobs constantly so hopefully will get lucky.0 -

OOH - not necessarily. How far under a year are you? And did you do as we said and raise a grievance? As I keep telling people - neither CAB nor ACAS are employment lawyers. Employment lawyers are people who actually do know the law and are sneaky to boot

Being there under a year applies to unfair dismissal, but not breach of contract, AFAIK. Sure SarEl can confirm, though!

I rang my employer/area manager and told him I couldn't live on 20hours wages, that I would lose WTC and it would be impossible to stay in my job.I did this when I was given the letter by my manager. I also pointed out it wasn't me who was regularly off sick.

His response was 'Thats your problem, cant help your personal circumstances, I am only interested in the running of the shop and you are not available to cover the sick/appointments so I need an extra member of staff without upping the wages bill ' . I said why not reduce the hours of those who are unreliable' and he said,' I have reduced yours' I hung up.
My first weeks wages was paid 10/09/2010.
They have 12 shops in our area and I wasn't offered hours at another store or relief work even though they generally have an ongoing advert for jobs - inside the stores.0 -
Yes Kiki - breach of contract applies from day one - but you can be sacked!
I am afraid that my idea wouldn't work - the OP is 3 weeks to a month shy of the 12 months marker - if it had been "just under a year" it might have flown, but I think that the month will get the OP sacked. Had she been within a week - week and a half of the 12 months I would have said to submit a formal written grievance to land on their desk exactly one week before the 52 weeks was up. Because if they had sacked her on the spot the statutory notice would have kicked in and she would have had the 12 months, making a claim for breach of contract and unfair dismissal. But timing is precise - if she submits a formal grievance now then they have time to sack her. If she doesn't she will have worked the hours for over a month before submitting a grievance which implies acceptance - she would have to reject the change now, and that doesn't fit the timescale she requires. Sorry OP - it was worth a try, but I think you are stuck with finding another job. And providing your contract allows for it, being toally unable to cover any extra hours due to sickness etc.0 -
My contract doesn't mention covering extra hours due to sickness etc anywhere, only that we may be asked to work at another store. My contracted hours were 31. I was doing 321/2 till I recieved the letter - between 615am and 10pm over 6days, Monday off.
Thanks very much for your time , I appreciate it. Yes I will be leaving asap, the search is on big time. The way things are we are just like 'cannon fodder' there and I have no loyalty or incentive.0
