Employment Tribunal Appeal

Hi All
Can onyone advise me, can I appeal the decision made at the employment tribunal on grounds that i can prove the respondants lied and just found they doctored a piece of evidence they submitted in the bundle file ? also how long do i have to get the appeal in ?

    You cannot. There are only three grounds upon which an appeal to an EAT may be lodged. The first (and most common) is a point of law. The second is "perversity" - that no tribunal could possibly have reached the decision that it did based on the evidence in front of it. The third is an erroneous exercise of discretion. Your are alleging a matter of fact - that the employer committed perjury and falsified documents. Had you been able to prove this at the tribunal then this would have been a very serious matter - but these are not grounds to appeal and the EAT will not accept an appeal based on these grounds. Perjury and faslification of evidence are a serious matter and it is both a criminal and a civil offence. But you would have to be damned sure that you are right (because it will be very costly to you to be wrong!) and you should not proceed on this matter without taking legal advice - and probably, in a case such as this, barristers opinion. Which in itself will not come cheap. But if you make an allegation of this sort that you cannot substantiate you could be sued.
