Council tax

I live with my mum and 2 brothers in a 3 bedroom house, and i have just been paing my mum bed and board. over the years my mum has got behind with the council tax and my older brother has, it's up to around 5k. Now my older brother is going bankrupt so will his part of the council tax debt be taken out?

Also they have included me and my younger brother on the council debt when where not on the tennacy agreement, i just pay house keeping...Now me and my younger brother are getting chased for a 5k debt, i've spoke to them and they won't split the debt into equal parts so i can pay my part as i want to get on and get my own place and don't want balifs knocking at my door...

Is there anyway i can get out names taken off or the debt spit up so i can pay my share if need be and have my name taken off?

    no, they won't split up the debt as far as i am aware. they would only take your name off the council tax bill if you move out..

    Can you confirm who is the owner or tenant please.

    If its your mother who's the tenant/owner then she has sole responsibility for the council tax and the bankruptcy of your brother has no effect on it.

    If they are joint tenants/owners then they are jointly liable and each responsible for the full balance. If one goes bankrupt then the other person becomes solely responsible for the arrears up to the date of bankruptcy and then they are both jointly liable again after the date of bankruptcy.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.

    I can't understand how your 'on it'. In hierarchy terms, you are resident but not on the tenancy. The only way I could see you liable is if mum and brother moved out making you the only resident person.
