My Story... (Need Help)

In May 2008 I was rear ended on a busy road. After the car was taken aaway, I was informed a few days later that the car is to be a write off. I thought it may have been because there was some un repairable damage to the main frame of the car.
After some months the other driver's insurance had agreed to pay out to my finance company, the value of the car ( I forget the amount ). We had our comepnsation through and everything was settled. Or so we thought....
A few weeks ago ( mid June-ish 2011 ), we were visiting some family not too far from where we live, and low and behold I see my car on the road pulling out of a Tesco car park. now, this is 3 years down the line and alarm bells have started ringing in my head.
I contacted the DVLA, gave them all my details and the car details and they tell me that the car has never been declared off the road or a write off. Not even Cat D. I am awaiting some details from a solicitor that I used to see if they know what may have happened to my car after the claim was settled.
The main thing that is bugging me is the fact that I still owe £3800+ on this car and the GAP insurance that I had taken out didn't cover the cost difference with the finance. It's 3 years later and I am in this debt for a car I no longer have, but would have paid for properly, or even finished paying for it had it been repaired.
I am in the process of seeking advice from the Citizens Adviec Beaurau, but I would like to know if anyone else thinks there is or maybe a case here of maybe getting my debt written off.
Any help appreciated.

Hi im sorry i have no advice, but i was really shocked when i read this. I imagine you must be fuming! Surely the car must still legally belong to you if you have never signed the log book over to anyone? Or did you have to sign some sort of paperwork regarding disposal of the vehicle after you were told it was a write-off?
I hope somebody comes along soon with some advice as this is truly shocking.0 -
I can't help about the not written off write off, but why didn't the GAP insurance cover this? Have you tried to reclaim the premiums as miss-selling?But a banker, engaged at enormous expense,Had the whole of their cash in his care.
