Long Term Sick Legal Question

No it is not "generosity" if it is part of your employment package any more than your holiday or wages are "generosity"! It is the whole package the encourages somebody to apply for a particular job - or not.
I'm aware that many jobs offer far less. However, if that is what was included in the deal then the OP is entitled to be paid.
some offer nothing0 -
They have to give you 28days that leaves 11 extra contractual days.
What they are saying is you lose all those 11 days due to not working a 1/3 of the year
That don't look right thye can't prorata the statutory holidays.0 -

Actually I've worked for them for 14 years with just the odd sick day in all that time. I was actually off with PTSD received while serving my country, so think twice before accusing someone of sponging off the tax payer!Mortgage - Free :j

But they can have a clause saying that you lose some or all of the EXTRA holiday if you take more than a certain amount of sick leave.0 -

But that clause is not on my 'Contract of Employment' where my leave entitlement and sickness absense are mentioned.Mortgage - Free :j

I didn't say it was and obviously I've not seen your contract, employee handbook etc.
I was merely trying to make clear that there could be all kinds of terms and conditions attached to holiday over and above the statutory minimum.
All you can do is carefully study the terms and check that they have applied them correctly. Obviously no term can reduce your basic legal entitlement, otherwise it would be unenforceable, but as far as I can see that hasn't happened.0
