Help needed with Daniels-Silverman

Hi there,

Over the past year I have been struggling to make ends meet due to my partner losing his job. Eventually I resorted to using Capital Finance One for a payday loan. (£500)

Unfortunately at the time this was due I was admitted to hospital for emergency surgery which resulted in me being off sick for 6 weeks recovering. During that time my employer put me on half salary meaning I couldn't pay anything to CFO.

I've been in contact several times and asked them to freeze any interest/charges whilst I got sorted out, which was firmly declined.

This morning I received an email from CFO's DCA (daniels Silverman) stating that if I did not make full payment of £1300 within 7 days I would be made bankrupt!!!!! :eek:

Working out the charges it appears I've been charged £25 per day as I've not been able to pay.

Had they not charged me the extortionate "fines" (their word not mine) I would not have crossed the threshold for bankruptcy. :mad:

Any advice as to how to deal with these people would be greatly appreciated.

    It will more than likely be hot air. However, do you have any other debts? You credit is already going to be shot, what harm could going bankrupt do? It may give you the chance to start again?

    it will cost them £1500 to make you bankrupt.
    Do you own your own home? Masses of equity? High performance cars?

    Why would they make you bankrupt? they wouldnt get a penny then. Make them a reasonable offer.

    hi i have had a similar problem with these guys , in 2008 i took out a locksmith franchise and as part of the package was a brand new vito van on competetive finance well thats what they said ! this was financed by the bank of scotland , in 2010 i decided that as the franchise company had not passed on the amount of work that i was promised i was forced to cease trading , as a direct result of this i was forced to contact the BoS and explain that i could no longer afford to keep the van , i was advised to by the BoS to send a letter explaining my position and that they would then in due course send a company to collect the van , this would then be sold at auction and i would have to repay the shortfall , in march 2010 i recieved a letter that explained the van had been sold ( no mention of how much it sold for ) and that there was a shortfall of 6202.45 and that a company called apex credit management would be in cont to sort out the payment of the balance , 2 days later apex contacted me to say that they were now dealing with the recovery of the debt . i agreed to pay 50 pounds a month and this was agreed by apex also , this was going well till last week when out of the blue i get a final demand for 3518.15 , no introduction , just a final demand threatening 7 days to pay or they would have to recover the goods and full payment , i phoned apex and they knew nothing about this , i phoned BoS and they told me that DS were the account holders i eplained that i had a letter from BoS stating that apex would be handling this , the reply i recieved was that as per the system it shows that DS are the account holders so this must be the case , i told BoS that i have been paying apex since march 2010 with no defaults , Bos then stated that they didnt know the van had been sold at auction as it wasnt on the system , i asked BoS to ring back in 10 mins so i could dig out all the paperwork and they agreed , i waited and waited but no call , the next day i rang BoS to find out what was happening and the guy i spoke to was very helpful , firstly i requested a copy of the bill of sale for the van so i know what it was sold for and what i owed on it , he told me he would request that for me , i also rang DS , well what a joke that was i spoke to the lady thats name was on the letter and while i was questioning her about thier companies involvement in this , and that i thought their letter was in my opinion threatening , she replied how do you work that out , i stated that the wording in the letter ( FINAL DEMAND in big red letters ) ( WE NOW DEMAND IMMEDIATE REPAYMENT OF 3518.15) she verbally accused me of only ringing to kick off at her and that i was looking to cause an argument , i also asked why they had 2 different amounts on the letter , i was then told that nearly 600 pounds was interest and collection charges , i told her that before i pay anything i will be seeking legal advice , so this is how things were left and im now waiting for them to contact again this week as the 7 days ends on tuesday , in the meantime i was horrorfied to read all the negative comments from customers of thiers and ppl that they have been chasing for money , looks like they are a second rate company interested only in threatening ppl with bully boy tactics .i have also done a bit of digging around on here and have found that in march this year a formers BOS employee had been appointed within the firm daniels silverman , coincidence ? it seems strange that i have been paying apex for over a year with no complaints from either apex or BOS and now all of a sudden i get this letter from DS only months after a former BOS employee joins the band of not so merry men , further updates as soon as i hear anything
