hi all,
I have been searching this site for advice all morning and cant find exactly what i want.......
My problem is the missus had a couple of debts from HSBC which she paid off through a DCA, but she cant remember the name of the original DCA.
They agreed a percentage of the full amount to clear the debt, and this was about 5 years ago,
but the problem is, a few weeks ago she received 2 letters from the now famous Mackenzie hall for the full amount for both debts, the letters show they got the debts from Arrow Global Limited, both companies were definitely not involved in the original debt and debt clearance.
Now unfortunately,
a) we have moved since then
b) she has changed bank
c) she hasn't got any of the paperwork any more
they are also calling our home, although we haven't contacted them yet.
After searching through this site i see there are options im just not sure what is right for us..... do we just request a CCA??
thanks in advance for any advice
dave

Hi
How did she make the payments to the previous DCA? Did she have it in writing at the time that it was full & final (even if she hasn't got that paperwork anymore) - or was it done via the phone. Can she see those payments on her bank statements from 5years ago? If she can does it show the creditor name and can you pinpoint a date more accurately than about 5years ago?
Don't do a CCA at the moment, that won't help prove that they debt was paid.
What were the original debts with HSBC (card, loans, overdrafts etc?)
Has she checked her credit file and what if anything shows on there?
Slightly obvious question but is she sure that these debts being chased are the same ones? have the provided details of the accounts or similar?A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
hi
it was a car loan and credit card, shes quite sure its them debts due to how much about 3500 and 1300, her family helped her pay it off, they gave her cash and she paid at a bank with there payment slip, so its not on her statements, she hasn't checked credit file, so have to try that, and the debt was paid off in april 20060 -
Right well first check her credit file.
Tell her not to reply or speak to MH at the moment. If she cannot prove the payment was in full & final settlement then another possible option she might need to try to spin this out until it becomes statute barred in April 2012 (I don't suppose you are in Scotland?).A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0
