1st credit - false debt claims

Hello all,

Not really sure I am in the right place but am after a little advice.

On Monday I received a phonecall I received a phone call from a man called Lee said he worked for 1st credit and he was phoning about my "Land Registry AA Loan", I wondered what he meant but answered a few questions, I wish I hadn't! He then proceeded to tell me I owed £4000 plus to this loan and that they own the debt and I needed to pay it immediately. I said I have a payment plan in place and am paying this off through the AA and Capquest, he said no you haven't we own this debt, I continued to argue that I was paying this and could he explain how they have this debt, he said we bought it off the open market, you have to pay it!

He then threatened to take out an attachment of earnings, all the time I am still saying this debt is being paid, this argument continues and I am getting angrier and louder and more upset but start to wonder if they do have my debt, he then threatened me with a charging order and as I continued to shout at him, he said we can make you bankrupt. I just shouted his name at him continually and he then hung up! Obviously there is no such thing as a Land Registry loan!

I then phoned the AA and they confirmed that I am making regular payments as agreed 12 months previously.

I phoned 1st credit back and told them this information but they still would not listen, Wesley this time. I said what part of I dont have a debt with you do you not understand?? I then asked to speak to somebody senior and he said there was no-one available, we will get somebody to call you back.

This time I called Capquest, they told me yes we are managing your account for the AA and have been since 21 June 2010, you are making regular payments and we and the AA are happy with this arrangement we have not sold the account, do not discuss this matter on the telephone with 1st credit and wait for them to send a letter.

Sorry this is longwinded!!!

Later someone claiming to be a manager phoned back, I told him what Capquest said, he said put it in writing and bye.

Yesterday Lee telephoned me again, I would not answer the security questions and told him I did not have a debt with them, he said I cannot discuss this and hung up again!

I phoned, I shouldnt have done but was angry and told the person I was going to report them for harrassment as the previous evening a manager phoned and had also said I would receive no more calls. This man then tried to tell me that nobody had phoned me, I thought their calls were recorded!

Please advise me what to do if I do receive a letter, I do not have this debt and am now starting to get stressed by the matter.

    I too have just had a letter from them telling me to contact them...
    I know I do not have any debts that they could possibly have. Everything has been settled bar a couple at my current address that are being paid...

    I plan on completely ignoring these letters until they tell me exactly what they think they have on me... I would suggest, not sure what others would say but get a letter from your lenders saying they have not sold your debt and are happy with your payments, and send a letter to 1st credit with a copy of this to them. I would also no longer deal with them on the phone but keep a paper trail of everything.. Lots of complaints have been made about this company and I am sure there will be a lot more yet!!

    Good luck with it, and keep us posted. I have only just had my letter so am waiting a few weeks to see what they do next! - It is just extra stress that people do not need.
  • Thank you for replying, I will not be speaking to me again although has told they will continue to phone me! I will wait to see what happens next.

    Ignore the fools for now.

    Don't speak to them on the phone. As you have already found, they have no hesitation in lying through their teeth if you do.

    If they really have bought the debt then they will write with details, which you can obviously check again with the AA/Capquest.

    I suppose it's possible that it has been sold and the customer service bods at the AA/Capquest haven't had their systems updated to say so yet? Or the AA have sold a load of debts to 1st Crudit and your details accidentally got included?

    Whichever way, there is no excuse for their behaviour.

  • Capquest and the AA told me on Monday after I spoke to them that they are receiving payments and that the information is up to date with the last payment received on 1 July 2011. Thanks.
