Employer wants me to repay him the ssp he's paid me

    The Employment Rights Act 1996. Look it up. It's part II but I can't recall the specific section - somewhere in the late teens or twenties I think. I don't do links to things that are in my head :)

    Allthough some sections are difficult to understan or require reference to other section many questions like this can be answered by having a read of this.

    section 14 is the relevent one.

    This probably also need a check to see if SSP payments are classed as wages to qualify if they want to rely on 14.1.a for the deductions.

    cannot take you're wage below NMW - would expect the op to be nearly NMW so can't just stop wages.

    Well pointed out - although this would not apply to final wages (where a debt is owed and notice is being served) and it still would not get the OP out of the bind of having to repay. Negotiation is really the only way forward, and it may be possible to come to some agreement. But the OP needs to be clear that if this isn't possible this is a debt like any other, and can be pursued through civil court, resulting in owing additional money for costs, and affecting their credit rating etc etc.
  • Hi everyone, Had a busy day phoning tax office, CAB, union and then finally got through to the right person in DWP. Hopefully when I get the ssp1 form and all my fitness notes which I gave to my employer back from him, (did ask for all of these on Friday) I maybe able to get my ESA back dated. Then I can pay my employer what I owe him. Think once I am fit enough, I'll be looking for a new job. So fingers and, toes crossed, that I get it.
