AIC - CCA request sent - Need Help Please

A little background knowledge before I get to the actual question. I had a loan with RBS which I defaulted on due to work circumstances. Anyway they passed it over to Triton Services who then came to a repayment agreement with me. After a few more months my circumstances changed again for the worse and I defaulted on one payment with Triton . After which Triton have passed it onto Allied International Credits Services. Who then sent me a letter demanding immediate payment in full and also left about 15 messages on my home phone ni the space of about two hours!!

After reading a little about it online I sent a CCA request to AIC in regards to the outstanding bank loan using a formal letter template I found on here.

AIC have contacted me twice since via letter. The first was threatening me with court action if I didn't pay in full. The second was a letter informing me that they don't have the CCA agreement and that if I want to see it I have to contact RBS for a copy of it. They are also still demanding full payment immediately. Which is obviously impossible as if I had the money I'd have paid the original loan back to RBS.

Anyway my question is: Now that AIC say they don't have the CCA agreement and claim they are acting on behalf of RBS to recover the monies. They are telling me to contact RBS for a copy of the CCA. So where do I stand now legally? What should my next step be?

Thanks for any advice you can offer me over this matter. It has caused me no end of sleepless nights so far and the stress of it is driving me crazy.

    I would ask for the CCA from RBS.

    Don't know about AIC, but a quick google seems to show they collect on behalf of clients rather than own the debt themselves.

    I've had a similar experience with another company, and it would be wise to play ball and get the CCA from RBS as requested. If it's any comfort, this behaviour of theirs is all part of the "dance" and although it's unpleasant will subside in time if you keep communications open until it's resolved. Payplan are helping me with my debt repayment and they are brilliant with creditors; it feels as if a friend is taking some of the strain. They are funded by the finance industry and so don't take a fee.

    Technically your correct in requesting the cca from those chasing. It's up to them to contact the OC for a copy.

    However, for the sake of another £1 make the request again to the OC.
    You could place the account in dispute with the dca / send the prove it letter to them in the meantime. Then just keep us updated.
