12 Year old debt......

Hi all new to forum, thanks in advance for any advice.

I deafaulted on Fiat car loan back in 1999, a default was issued but no CCJ as iagreeed to pay them,
my last payment to them was in Jan 11 then i stopped just because it had reached the £4100 which was total interest for the car loan and i thought sod it i've had enough.... it was passed to wescot i CCA'd them about two months ago and blow me down they had a copy of the orginal TC sighned by me aghhhhhhh..... i could not believe it, anyway this was at mums addrerss, mum said id moved from that address go away, and they found me at my new one last week, ahhhhh, so in short it is my debt it was a teerrible skank car deal 12 years ago i have been paying and now wescott say CCJ time... can they still give me ccj after a default 12 yaers ago??? I will offer to pay them 10 a month in the next week....but if wescot say no.... then i think i would rather go to court and see if the judge would throw it out.....im not going to fill out one of wescots I and E forms but i know that if it goes to court and i do show all my outgoings and incomings it will end up being a minus a month......phew anyway only waited 12 years to ask...im up to date on all my other debts.. and default went of file six years ago:eek:

    Unfortunately because you have been paying all this time, the debt is still enforceable in the courts.

    Do Wescott own the debt?

    Only the owner of the original debt can take legal action against you, and if Wescott purchased the debt then yes they can, but it is highly unlikely they will after all these years.

    Have you not got any savings etc?

    I work for a DCA and if someone phones us with an offer of settlement, sometimes 70% discount! I have had £4000 balances accepted for a £1000 settlement, so anything is worth a try!

    If not, I would cont to pay them the minimum you can which is justifiable as there is no point risking court action when you've paid for this length of time :)

  • Hi i did ask Wescot but they are only acting on behalf of fiat.....i asked them settlement they 2400, but i could go in less, was thing of 1000, but for now i am just going to offer 10 a month i will let you know what they say....

  • Yeh, that's jst a standard settlement they offer, probably 60% But I would call in and ask them to put a profile forward to Fiat, as we are given an amount to stick within but if a customer like urself calls and offers a lesser amount we contact the client and request a lower settlement on special circumstances.

    If you say that you are in extreme difficulty and state that you can only afford minimum a month if the settlement is not accepted, there should be some room for negotiation!
