How Much notice do I need to give?

Hi,

I have given my notice in at work but have been told by my Manager that I have to give 2 weeks.

Does anyone know what length of notice I need to give legally please ? I have worked there for 3 1/2 years and get paid monthly.

It depends entirely on what notice your contract requires you to give. The statutory minimum is one week, but your contract may require more.

i thought if you were there for over a year then you went by the amount of notice in the contract,

For being there so long it's usually a month so 2 weeks is pretty good.

Have you any leave that you have accrued that you can use in the last week to leave earlier?

You go by the amount of notice in the contract no matter how long you have been employed.

The employee is only required to give one week's notice unless the contract requires more. The length of service is not relevant.

If the situation was reversed, the employer would have to give one week's notice for each year of service up to a maximum of 12 (again unless the contract specified more. A contract term giving less notice than this would be illegal and unenforceable).

It may seem unequal but that is the law.

I checked my contract and it does say 2 weeks , don't know why I didn't think to check it !

Its all based on your contract. The law says a week from both parties but usually employers are nicer than that in their contracts. Most people give two weeks to allow the employer time to adjust the workload of a team and to get a replacement.

For the OP who has been employed for over 3 years, the law would require 3 weeks notice from the employer unless longer were specified in the employment contract.
