    so they were being underpaid???

why not challenge them when the pay was short ie 50 hrs at £8 is £400!!??

My OH did query his wage every week with his employers but they just said if you can't make it pay you know where the door is. In these times and in this industries jobs are very much like god dust where we live so it was a case of put up and shut up.

I think the payroll scheme was made up each week to suit the cash flow of the business.

I'm just glad he has another job now which what seems a 'proper' company with an HR department

it is for a company to prove they were paying him the right rate for the hours work and they have to legally keep correct payroll and employment deatails of hours worked.

Inland Revenue can go into any company at any time with no announcement to check they payroll

I would write a letter to the company giving them 7 days to pay what is due or go to get legal advice.

IF they haven't issued a P45 they are also breaking the law!

They have not issued a P45.

Last night my OH spoke to a very good friend he has had for years who also has the unfortunate pleasure of working for this Company and apparently two doors that my OH fitted in his last week have been pulled by one of the Contracts Managers and he got someone to replace them. The doors the company use are £17.50 each but my OH friend has said that they have allowed the person who replaced it to book in my OH's wage for his last week.

The week my OH was working his notice his work was checked several times by the Contracts Managers and they said they were surprised he was still turning up and doing a quality job as most people didn't do much in their last week. His MD also commented that he was one of the very few people who had returned all his PPE and his van in a good condition and should things not work out at the new Company his door would also be open.

Can they use the doors to with hold his wage?

I'm going to write the letter today and send it by email and recorded delivery.

Note that there is a strict 3 month (less one day) time limit for Employment Tribunal Claims. Take care you do not run out of time or get strung along. You can always withdraw the claim if they do pay in the meantime.

    Thanks uncertain.

Interesting point, think I will open a claim now and close it if we receive the money. Can see it being an up hill struggle with these cowboys
