company sold but not our shop, how can i stay?

hi all

the company i work for was bought by a competitor this week
the OFT say that my shop is to close to a shop of the new companies so one of us has to be sold again, it will be sold with all staff to another competitor, this will be decided in a few weeks

the only way i can see me staying with the new company and not being sold to another one is to apply for a job in a shop that does not have to be closed due to proximity, there are jobs available but i have a problem

my shop has had to have adjustments made for myself due to my disability, the shops that have vacancies do not have what i need, do i have any rights? if i ask for a transfere now can they turn me down on these grounds? i would like to stay with the new company and all the other staff that will be moving over too

    Mostly but there are a few things that are not clear. You said that other staff are moving to the new company's shops - all of them? And how did they "move" - did they apply for other jobs with them? And before you start talking about rights - because that is confrontational as a starting point - have you asked the new employer any of this?

    So everyone from your company will be tuped over to new company(a) and transferred with the store they are in, your store the new company(a) cannot keep due to the OFT so you will be tuped over to a different company(b) when company (a) find a buyer for your store is that right? If so i don't see why you need to move anyway as you will still have a job and the store is set up for you to work in.

    the whole company has been bought the shops already established will just run as they are so in effect were being TUPE'd

    i will use actuall company names it makes it easier

    i work for TOTE bookmakers, bet fred has just bought us, the OFT has said that in the UK 21 TOTE shops are to close to bet fred shops so fred has to choose which ones to sell on, we were told we would be sold (if its us rather than freds shop) to another large competitor such as corals

    i would prefere to stay with fred and all of my work friends in the other tote/betfred shops

    my shop was fitted out for me, due to my disability, no other shop in my area has what i need

    although money has been exchanged, the descision will not be made on which 21 shops will go for a few weeks so there is time im told for me to relocate to one of the other shops as some were understaffed and the vacancies are still being advertised, but i do not think that fred would spend money on another shop for me when in effect i allready have a suitable shop, the other staff in my shop have allready enquired about the other vacancies and told that the chances of them being able to relocate before the descion looks good, this leaves me on my own because the unofficial feed back i have had does not look good

    is there something anything i can do, do i have rights?

    thanks i understand what you are saying but the other staff in my shop that also want to stay an be tuped all together have the option if there quick to be staffed at another shop, i do not have this option due to my disability, yes i will have a job but i do not really want to start with a new company on my own

    Yes - you have the right to the job that you have I am afraid. You can apply for other jobs just as others are doing - but you don't have a right to another job and you would have to prove that the decision not to offer you a job was based on your disability and not on others factors such as your not being the best candidate for the job.

    In situations like this where one company goes and you end up working for a new company sometimes it's better to look at it as a new job, with a new start, new work colleagues etc, every company operates differently so your job will change and rota's etc will change some of your work colleagues may decide they don't like the new company and if as you say there's currently vacancies at other shops it sounds like theres already high turnovers off staff, it may be best for you to stay where your comfortable and provisions are already available, i went through a tupe a while back and not many of the staff are working in the same company now and i'm talking about staff that where with the company for years, just a little advice, hopefully someone will be here with more helpful advice to your actual problem. :)
