DCA making Credit Report Entries

We are on a DMP with CCCS and have been for 7 years with unfortunately a lot more to go but most things have been plodding along fine. My DH just had a phone call from DLC regarding a joint debt they recently took over. I had been receiving mail and phonecalls from them so asked them to stop phoning me and I sent the letters on to CCCS. That was fine but now they have started sending letters to my DH and today the phonecall:mad:. He eventually handed the phone over to me and after I had gone through everything yet again with them regarding CCCS I asked why they have two seperate payment references for us - same client ref though. She said this was so they could update each of our credit files. As our default was over 5 years ago this debt no longer shows on my Experian file - the only one I've checked today. I told her that as the debt no longer shows she cannot update it as a new debt as that would be against the ombudsmen standards. She went off to speak to a senior manager and just came back saying "that's fine I'll update your husbands records".

Was I correct or will we start seeing this debt again? My credit file looks not bad compared to five years ago except for the two defaults that RBS waited until 2008 to put on:mad::mad::mad:!!!!

If the accounts had defaults registered over 6 years ago that have now fallen off your reports, then they are not allowed to record anything at all new on either of your credit reports.

Sounds like the person you spoke to either doesn't have a clue what they are talking about, or is fibbing.

    Thanks Fermi

That's what I thought. Will have to keep an eye on the credit reports to make sure nothing appears.

Was okay about this debt being passed over to a DCA as the original creditor First Plus were holding a seperate account with added interest from the original debt which they told us if we ever went for a settlement figure this would have been added - at last check that was over £1000 so at least that seems to have been wiped now.
