I have printed off my online bank statement which shows the transaction and date though doesnt actually state what the item is - just the amount. I have also googled this toy for reviews (yes I wish I'd done that before) and they are all terrible and agree with the complaints i have i.e that the toy is very badly designed and impossible to play with without it falling apart.
Anyone any thoughts as to where I stand?
Any replies greatly appreciated.
You will be fine and can take it back to the shop for a refund.
You have no legal requirement to produce the receipt. (Since, legally, they have no requirement to give you one). The store can ask for reasonable proof of purchase, and your bank statement is 'reasonable proof' - not everyone keeps every receipt for years.Says James, in my opinion, there's nothing in this world

IMO
The item had an inherent fault which was present at time of purchase,Q1. What is an inherent fault?
A fault present at the time of purchase. Examples are:
• an error in design so that a product is manufactured incorrectly
• an error in manufacturing where a faulty component was inserted.
The "fault" may not become apparent immediately but it was there at the time of sale and so the product was not of satisfactory standard.
so it wasnt of satisfactory quality and its defintly not fit for purpose now.1.Wherever goods are bought they must "conform to contract". This means they must be as described, fit for purpose and of satisfactory quality (i.e. not inherently faulty at the time of sale).
2.Aspects of quality include fitness for purpose, freedom from minor defects, appearance and finish, durability and safety.
as for a receipt under the law a retailer doesnt have to give you one when you buy and so you dont have to produce one to return goods, at most you would have to prove that you purchased the item ie. bank statement but if the shop was helpful they would know if the item belong to them or not by way of checking for your card number (if you paid plastic) or serial numbers, bar codes on the item itself etc etc.
remember the law is on your side if goods are faultly. I took my moms tv back when if broke after 9months and got it replaced. I said it wasnt fit for purpose because it was broke(they couldnt argue with that) and for it to brake inside 12months there must have been a inherent fault at time of sale.0 -
thanks for the replies - I will give it a go today!0

Just an update - took this back and got a gift card which I was happy with as my dd will have no problem spending. Wasn't too much hassle, think it helped that I got a nice MOS. Glad I didn't just chuck it in the bin (where it belonged).
Thanks again all!0 -

Sesh, I'm glad you're happy - just want to make sure you know that in future you don't have to receive a gift voucher - if you want a full refund you're perfectly entitled to it.
Enjoy!Says James, in my opinion, there's nothing in this world
