Agency worker rights after 1st October 2011

Hi
I believe there is new legislation coming in on 1st October 2011 relating to Agency workers that after 12 weeks they will be entitled to the same pay and working conditions can some explain what this means in relation to
A. Agency worker getting a lower pay rate that the person
employed by the company they are working for, will they be now
entitled to the same rate and overtime rates etc, after the 12
week qualifying period.

B. Hours worked will that be same and will they be paid even though
lack of work or no work usually means the agency worker
wouldn't get paid or reduced hours.

c. Holidays and sick pay.

I am currently working as a agency worker £10ph employed staff
paid £14ph OT rates paid after 46 hrs employed , employed staff
after 40 hours.Laid off if no work or reduced hours without any real
notice.

    company's will find ways round this new legislation, eg after 10 weeks they will probably lay you off and use another agency, at the end of the day it will probable be worse for the worker not better.

    There already is a way around it. Sign people up as self employed. All they have to raise is a cheque for the work time and they save money without needing to spend so much time in payroll. Its far easier for agencies to then not use your services again.

    So in theory would I be paid the same as the people permanently employed but reality I wont?
    Some people have been on for a year with no offer of a permanent contract just wanted to know if this legislation would force the issue or make it worse.Better start looking again.

    Well consultants won't be able to sit on jobs now and get all the gravey for it but it will enable the just to switch people around I cohoots with employers in a more sinister way meaning they will have to plan better. I think it will be good as it puts the onus on employers to make a choice about temps. Surely a business that continually uses temps is in trouble as they can't commit to employing someone.
