Hoping someone can help me out here ...
Around 2002 - 2003 my son become quite ill and I had to give up work, this meant that I couldn't pay HSBC back for my massive £9000+ overdraft or credit card, I also owed 10+ other companies money and was being chased all over the place by different debt agencies, to give myself breathing space I setup a small nominal payment with each and paid via standing order ...
Other the years the debt companies have sold these debts on numerous times and I lost track as to who and what I had paid of what debt, some years back I also made some one off final settlement payments and was then still getting chased by other companies for the same debt...
Enough was enough so I cancelled all standing orders and wrote to each company asking for them to give me a statement of account, prove they own the debt and supply me a copy of the original credit agreement, most have gone very quite and a couple even wrote the debt off as they couldn't, thats except one, Rockwell, they have said" that they are acting on behalf of their clients Phoenix Recoveries who purchased the account from HSBC back in 2007, the interesting parts on the letter are these:
1) They say that as the debt it specifically relating to a current account it is not regulated by the consumer credit act and as such they do not have to provide a copy of the agreement, is this correct?
problem is as it's so long I don't know if the debt was for my overdraft, credit card, loan or all combined, it was a very stressful time.
2) They say by me making previous payment was my acceptance of the liability, again is this true?
The statement they provided me shows only payments since they took over the debt in 2007, I am lost as to what to do ???
Thanks

1) Partly correct. For an overdraft there is usually no signed agreement required, and a such, any requirement to provide a copy of it doesn't apply.
2) Making payments doesn't make you liable. However, if you know the debt is yours, then it's not really a relevant issue.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB

Thanks for the reply ..
One of my points is that I don't know what the debt was for, I know it's for HSBC but not for which service, I know I paid the credit card to another company but this Rockwell amount looks like they have added all debts together0 -
Might be worth doing a full SAR, so that they/Phoenix are forced to disclose all the info they have on accounts.Free/impartial debt advice: National Debtline | StepChange Debt Charity | Find your local CAB
