Anyone know the answer to this? Is a BRU stored on any searchable (by credit companies) database? Will the BR still drop off your file 6 years after your day in court?

    Thanks

Just been on the phone to the insolvency service, the information commisioner and experian, and no one seems to have a definative answer, Experian seemed to think that only the BR will show up and not the BRU/O but he didnt seem to confident when he said it.

    Thats some spending spree

Between 04 June 2010 and 29 June 2010, whilst insolvent, she disposed of £12,700 to the detriment of her general body of creditors. She cannot recall exactly how she spent the money, but she used it to fund her lifestyle.

I've now heard back from the ICO regarding a change in the way BRO/U's are reported on your CRFs, for some it is not such good news and for others there is no change

BRO's and BRU's will now stay on your CRFs for a MINIMUM of six years from the date they are awarded.

    So, for example

    You go bankrupt on 15/5/2007
    BRO/U awarded for 5 years on 01/5/2008
Your bankruptcy will fall off 15/5/2013
Your BRO/U will fall off 31/4/2014

If the BRO is for MORE than 6 years it will remain on your CRF until it has expired, but will then fall off immediately

    You go bankrupt on 15/5/2007
    BRO/U awarded for 10 years on 01/5/2008
Your bankruptcy will fall off 15/5/2013
Your BRO/U will fall off 31/4/2018

And this time it looks like it wasn't the creditors who asked for this, it looks as if it was the Insolvency Service, as they felt that if a BRO/U is awarded then it is for reckless behaviour, etc, so should be highlighted for the normal reporting period of 6 years minimum.

So would the £12,700 be excluded from her bankruptcy and she would have to pay it back?

It's still included in the BR. Reading between the lines, there may be unexplained cash withdrawals from bank account/credit card and she refused to say what they were used for.

although if she for instance gave the money away or something like that, then the OR may be able to recover the money, but like JCS1 says if it has just been spent, there is not a lot that can be done

I've just been reading this thread and am now a bit worried.

I stopped paying my creditors about 2 years ago. I had a chat with cccs two year ago and they advised bankruptcy. I then panicked and tried to run away from my debts and bury my head in the sand.

I never took any further credit or used any credit cards or credit I already had. Then a few months back I got an attachment to earnings and this again panicked me into sorting my problems out.

Will the OR punish me for this and give me a bro/u? I was so scared I just didn't know what to do and tried to run away from it.

I'm so scared about my interview this week :(

nothing to worry about BRCLUB, you would have only done wrong if you used more credit or disposed of all your assets
