Question on old (unpaid) ccj please ;-)

Hello Everyone,

I have an unpaid CCJ for around £1200.00 recorded on my personal credit file, I haven’t a clue what it relates to but can only assume it was something to do with an old failed business (limited company). I have never had any correspondence whatsoever regarding this.

The date of the CCJ was almost 6-years ago so (hopefully) is due to drop off my file very soon.

My question’s are:

1) I am scared to contact court to enquire what the CCJ relates to as it might open a can-of-worms. Would contacting the court prompt them to start chasing me?

2) If I just wait to let it drop off (after 6 years) can the original creditor go back to the court and ask them to update this as being unpaid, and if so, could this then show as a new CCJ hence being on my file for a further 6-years?

3) In the worst-case scenario; if the original creditor did go back to the court, would I still then be given the standard 30-days to pay (so that it wouldn’t appear on my credit file)?

Thanks very much in advance

They can go back to court, but they are unlikely to get permission to enforce a CCJ after 6 years.
If you've have not made a mistake, you've made nothing
  • Thanks for your reply RAS, my biggest worry is; if they were to go back to the court could this potentially show on my file for another 6-years?

    Thanks again

    1) I am scared to contact court to enquire what the CCJ relates to as it might open a can-of-worms. Would contacting the court prompt them to start chasing me?

No, the court will do nothing of their own initiative. If the creditor contacts them regarding a bailiff's warrant, attachment of earnings etc, then they will act.
    2) If I just wait to let it drop off (after 6 years) can the original creditor go back to the court and ask them to update this as being unpaid, and if so, could this then show as a new CCJ hence being on my file for a further 6-years?

The ccj drops off the credit file six years after the judgement. That doesn't stop the creditor enforcing the judgement but they would need specific permission if there has been a gap of six years since the last activity. You can't have a new ccj on this debt.
    3) In the worst-case scenario; if the original creditor did go back to the court, would I still then be given the standard 30-days to pay (so that it wouldn’t appear on my credit file)?

No, the judgement stands. But, for instance, if the creditor requests a warrant, you can suspend this and vary the order to pay in instalments.

After this time, it's unlikely that anything will happen on it. I think I'd leave it alone. But if you wanted to phone the court to find out what it is, that would do no harm.
