I have just pulled my head out of the sand. I have been very foolish and three and a half years ago moved out of the country and stopped paying my debts.
I came home 18 months ago called the companies I owed money to spoke about what I could do and then instead of doing something I continued to ignore the letters falling on the door mat. Now I am ready to tackle this. I need help. I can afford to make payments until they are paid off, if I list my defaults on my Credit Report.
Argos store card: Defaulted in July 2008,
I owe £1085
Barclaycard Master Loan: Defaulted in July 2008
I owe £9033
I must add however this is the interest on the loan! I paid off the actually principal and the money remaining is the interest and charges that I should have been charged.
Lowell Porfolio: Defaulted in August 2008
I owe £500
Capquest (Sainsbury credit card) : Defaulted in July 2008
I owe £4025
I owe MORE than this, but they are not on my CR, any of them. My overdraft from Santander which was £2000 came off my report, I think by mistake. I also have at least another two that are not on there. I have a CCJ from a from a nursery school provider who I lost a court case against she charged me nursery fees in lieu, which even though my children were not in nursery, because I never gave notice she charged me and won. I absolutely refuse to pay her the money I (don't) owe her! This was applied in December 2007.
How much would you offer this creditors? If I pay them off will they stay on my report for six year from the last day that I paid them, and if that is the case would they show that I defaulted? Because if they do then I may as well let them run the course for the six years?
I am in position to pay regular amounts, but before I call each one I am wondering whether I am in the position to neogiate as I am not going to be able to get credit until 2013 anyway because of the CCJ?
Input please would great.

The defaults will stay on you file for 6years from the default date. But if you decide not to pay then its possible your creditors could take legal action and obtain CCJs, which would then stay on your file even longer.
Are you in a position to offer full & final settlements or do you want to make monthly payments towards these?
If you are offering monthly payments then you might want to consider approaching one of the debt charities and doing a DMP through them. If you feel you can and would rather deal with this yourself then the principle should be the same as the charity would use. That is to work out an income & expenditure to include reasonable living costs (but not luxuires) and excluding debt repayments. Then that will tell you how much you have available for debt repayments each month. You can the split that between your creditors (the fairest way is to split it pro-rata based on the balances you owe) and write to them and offer that as your monthly payments and request that the freeze interest & charges.
As you lost the court case what if the plaintiff decides to take further recovery action against you (such as instructing bailiffs or applying for an attachment of earnings etc). Did the court order allow her to charge interest on the CCJ whilst it remains unpaid?A smile enriches those who receive without making poorer those who giveor "It costs nowt to be nice"0 -
It depends on what I could get away with offering to be honest. I certainly do not have £15,000 available to pay back in one go but I do earn a decent wage...after get this.....completing my accountancy degree!
I would prefer not to use a company to help me, but to do it on my own. I have quite a bit spare each month, but I don't want to pay back more than I have too. What settlement figures would you ask for if you were me?
Most the accounts seem to have froze interest because the default amount and amount owing are the same, apart from one, Capquest, who have whacked £700 of interest on.
The plaintiff did try to get the baliffs in but I moved away less a month of losing the court case she knew I was moving and therefore didn't bother pursuing it.0
