miss 2 payments on secured loan with First Plus threat of home visit

Hi, To cut a long story short, our bank account was hacked into on the day our secured loan payment was due, therefore it went unpaid. This still hasnt been resolved & a 2nd payment was missed leaving us 2 months in arrears but we are now in a position to resume payments. We kept First Plus informed of this by letter from the very beginning (none of which have been responded to) and all we keep getting are threatening letters saying they will be visiting us at home to collect the arrears. I refuse to contact them by phone as they employ bullying tactics & I am scared, we have informed them every step of the way what is happening and asked if we can restructure the loan to add 2 months onto the end of the term and continue with repayments from August. No response. They keep sending us letters saying we are ignoring the matter, even though we have written to them about 5 times, they are ignoring our letters. Can they turn up at our home? We have no money, no savings, no car, no assets, are both on debt management plans for our unsecured debts (with CCCS) and they are refusing to answer our correspondence, I do NOT want to ring them. Can they take our home? We are up to date with our normal mortgage (FP have 2nd charge on it). We have just missed these 2 payments. If they turn up at home this will be very distressing as our young son usually opens the door to anyone, and we have no way of paying them. DOes anyone have any experience of this please, as I am at a loss what to do now. We are £433.38 in arrears and cannot pay this, we can only resume normal payments from August and have even sent them a new direct debit form to do this - but can they take the full arrears amount with the direct debit instruction? Please help, thankyou :-( BTW the house is in negative equity to the tune of about £35,000.

    Sorry, I don't really know much about them but just wanted to check when you wrote to them did you send them recorded delivery?

  • Yes, I have kept copies of all correspondence I have sent (all sent recorded) and all copies of their letters sent to us. I have had no response to my correspondence, all I have had is computer generated letters from them saying we are in arrears and must pay immediately, these are coming every other day, and the latest one behind the doormat when I went home for my lunch hour stated they would be "making a home visit to discuss the arrears". Is this legal? Can they just arrive on my doorstep? I have written to them with a new direct debit form so they can reinstate it, as we can start paying again now, and have also offered to pay £10 a month extra on top of the normal monthly payment to clear the arrears that way, or asked them if they would consider restructuring the loan whereby 2 months is added to the term and to spread it that way. I am not ignoring this or refusing to pay. We have kept them informed and have had no response to our proposals. I am at my wits end and terrified of answering the door.
