He was using it as an example and an intelligent company would get rid of someone they don't want when they have the chance and if it doesn't work hire someone else that is more inline with who they want.
no they couldnt afford to keep me since I had been there 5 years and was the highest paid in the team and since the company had lost 15 of 45 sites in 5 years it wasn't cost effective to do so. I had been there 5 years so they took their time gettting rid

Precisely- and I personally love my job, I worked very hard to get it and I don't think money would make up for the grief I have had to endure on the past few months after 4 and 1/2 years of hard graft, and 2 of working after owkr to get the experience and get in thearea I dream of. Anything under a year's salary is not worth it in my opinion... and I am tired to telling a friend of mine that no, 8k is not attractive enough and I will not take their dirty money and go quietly when I know they are lining up interns to do the job of people being made redundant at the moment.
So that is a point that people should remember- redundancy money is not a good option for all... for many different reasons, and I think the main one, for me at least, is that it is not our choice. It is rather the lack of.

yeah when you just get the statatory payout then it's not even worth it

Looks like they got you and you failed to realise in the 3months you had to raise an ET.

I would ask yourself what was it about you that made them decided they no longer wanted you.

In the future don't believe everything an employer tells you.

what did I do? Erm nothing as I was the senior one and used to tell everyone else how to do their job. I was never pulled up about anything work wise and good good appraisals and if they wanted to get rid with no pay then they could have just sacked me for whatever it is you may think I did!!

Someone had to go and it was me as I was on the most £££ & holiday pay

ET? Employment Tribunal? How would I know they had someone else there? and besides someone on here said they could do that a week after if they wanted to

that's precisely my point...they used it as an excuse to get rid of you because you were to expensive and now can hire someone that is cheaper...immoral?..maybe....illegal...probably not

Yes I was on £13.40 an hr and was told they took two people on and one was earning minimum wage ahd she was 18 years old with no experience so cheaper a lot cheaper and she was doing the automated work that the new system had created to easy to train on and do not need accounts experience to do that.

Amazing how peope forget the cruicial bit of information when making claims of injustice.

What happen here most likely is something like.

Boss sees an opportunity to cut costs so makes a plan.

New computer system and new structure gets rid of senior "I know everything, overpaid person" and another about to go on maternity and replaces them with 2 junior data entry clerks.

What they probably should have done was offer you the data entry job as a potential suitable alternative.

For the maternity person they have to pay anyway so best to leave the job open a lot can change also a bit harder to make redundant now, than it will be when they come back if there are no suitable jobs and if there is a job why no keep them.

No one took your job so now your ET claim would probably be they didn't offer you the data entry job.

    Would you have taken it?

I for sure was not 'overpaid' in fact underpaid for what I was doing all I said was I was the highest paid and that don't make me over paid!

Like I said they told me there were no jobs and even if there was I never knew they took anyone on so I have no claim.

I would have stayed there on the minimum wage if it was that or no job (while I looked for a new job).

    I believe in Karma :)

Hi, sorry to but in and take my thread back :rotfl: lol just kidding.

But to let you all know whats happening, she went in to see them and they confirmed her role is being split between 3 of them, so basically cutting back on wages and cuttin 4 staff to 3. She explained that she is just as capable as the others and more qualified than some of them, and have they done job capability scoring.

Apparantly they didn't know about this job scoring, and said ok you have a point to be considered, we will do this and let you know the outcome in 2 weeks time.

So she wont find anything out now until 2 weeks. To be honest like someone said before, it will be easy enough for them to rig the criteria if they have already decided they want her gone, but we will see.

Money wise, they said she will get one weeks pay for every year she been there (3) and one months notice paid which she doesn't have to work. Not a great amount of money but hopefully it will be enough to last until she finds a new job.

Thanks for your help guys and girls and if any one has any more advice/comments, always appreciated.

    Hello Manchester
I am glad to hear she has taken action...remember that if the outcome is 'funny' she can always ask for the notes from interview/assessment...A colleague of mine was in this situation and didn't get to retain his job (after 35 years doing it and with no one who could do it as well) - he asked for the notes. They were 'lost' and it turned out thet HR person (who is supposed to be impartial) was going out with one of the managers invoved int he interview process (out goes the impartiality as obvioulsy they could discuss these things at home) ... in the end, he challenged the process and he ended up leaving with a compromise agreement of ... (ready?) : £100K on top of his pension and redundancy...

I hope your girlfriend doesn't have to go through anything similar, but just to highlight how important it is to fight for what you think is fair.
Good luck, and keep us posted (I am waiting to hear form me appeal as well)

Great if he was on £10k a year, not so great if he was on £200k a year not so good and would only take the company 1/2 a year to recoup. These high amounts tend only to be for those on high salaries and the OP needs to realise that these numbers may not be realistic

Also HR are not impartial........never are.......never will be

That's all true...my example was used to highlight the fact that you cand and shoudl challenge a selection process if you feel something unfair or intorward has been going on.
And that is very important to remember: HR act on behalf and supporting the employer. Not the employee. I had people coming to me for advice as Union rep after naively thinking the HR would look after them. Well, in these situations, they don't so unless you have a very sympathetic HR person who offers you suport with redeployment options o training opportunities, for the serious stuff, talk to your rep or a legel representative if you can.
  • Hi guys,

The news is that they had my girlfriend in a meeting and decided that they are not making her redundant now. They said she proved to them that she is needed enough in her meeting. So thanks to you all on here, i think the advice you gave about the job capability scoring was the one that made them realise she did her research and knew where she stood (well, i did it for her lol)

    Thanks a bunch.
