There are circumstances where this perfectly legal and no comeback for someone made redundant
so if I was told there was no job for me and the other person was going on maternity leave and she wasn't to be replaced they can replace her and me 2 weeks after she has gone?
How fair is that? surely then the roles are not redundant0 -

Yeah but only in certain circumastances such as if the companies economic situation suddenly changed. It would be up to the company then to prove this was the case if taken to court..0 -

my company didnt make me redundant do to the economics it was because they installed a new Accounts System that halved the work so they were going to git rid of once of us0 -
well at the least a nice redundancy payout is on the cards?
if not, and a hushed up 'get her out of here' job, then tribunal is your friend! unfair dismissal etc.Target Savings by end 2009: 20,000
current savings: 20,500 (target hit yippee!)
Debts: 8000 (student loan so doesnt count)
new target savings by Feb 2010: 30,0000 -

So the justification is the new system will reduce work load.
Reduce headcount through redundancy.
That would be a legitimate redundancy
2 weeks later OH s**T we can't cope the sytem does not work as promised/expected we need more people.
legitimate hiring situation.0 -

Why would an intelligent company pay me off BEFORE they went live with the system. Surely if they had a brain they then would have waited till we were live to see if they really needed all 4 of us then make a redundancy.
I know this was just a ploy to get rid of me as I told there was no job at al in the company for me to do , not even to cover the person who was leaving 4 weeks later to go on maternity as she was not going to be replaces as they never intended too , but then did
They never even gave me the right to appeal so I know they never acted above board0 -
not at all like that as I was told they were coping well by my old boss

Looks like they got you and you failed to realise in the 3months you had to raise an ET.
I would ask yourself what was it about you that made them decided they no longer wanted you.
In the future don't believe everything an employer tells you.0 -
not everyone who gets made redundant gets a good pay out
Precisely- and I personally love my job, I worked very hard to get it and I don't think money would make up for the grief I have had to endure on the past few months after 4 and 1/2 years of hard graft, and 2 of working after owkr to get the experience and get in thearea I dream of. Anything under a year's salary is not worth it in my opinion... and I am tired to telling a friend of mine that no, 8k is not attractive enough and I will not take their dirty money and go quietly when I know they are lining up interns to do the job of people being made redundant at the moment.
So that is a point that people should remember- redundancy money is not a good option for all... for many different reasons, and I think the main one, for me at least, is that it is not our choice. It is rather the lack of.0 -
Hi, sorry to but in and take my thread back :rotfl: lol just kidding.
But to let you all know whats happening, she went in to see them and they confirmed her role is being split between 3 of them, so basically cutting back on wages and cuttin 4 staff to 3. She explained that she is just as capable as the others and more qualified than some of them, and have they done job capability scoring.
Apparantly they didn't know about this job scoring, and said ok you have a point to be considered, we will do this and let you know the outcome in 2 weeks time.
So she wont find anything out now until 2 weeks. To be honest like someone said before, it will be easy enough for them to rig the criteria if they have already decided they want her gone, but we will see.
Money wise, they said she will get one weeks pay for every year she been there (3) and one months notice paid which she doesn't have to work. Not a great amount of money but hopefully it will be enough to last until she finds a new job.
Thanks for your help guys and girls and if any one has any more advice/comments, always appreciated.0
