hi, been a stay at home dad since birth of our 3 1/2 year old. agreed 50/50 ish joint residency in that I have mon - thu 5 one week and mon - fri afternoon the next. wife has put in counter claim for cb, will she get it and is there anything I can do apart from sit and wait, she has already accused me of benefit fraud etc..

There is no such thing as shared care regarding benefits it's one person or the other. It is usually the parent who has the child the most number of nights that can claim the benefits - who has your little on overnight the most? I would count the nights over a two week period as you seem to be working on that timescale.0
