Overseas Debt Queries

Hi there

I have been out of the UK for 3 years now however still have some debt in the UK. Unfortunately, I have been left with about 8k of debt in my name after a nasty break up where my ex has refused to pay his share. Because of the situation, I have written to all of my creditors explaining the situation, and asking for copies of the Credit Agreements so that I have something with his name on. I have found the forum to be very helpful and have used the templates etc from you guys for the letters :)

As it stands, one company came back to me saying that they do not have a copy of the agreement and so will not be asking me for any more money :D however, there are still 2 outstanding - one from MBNA and one from HSBC. After writing to them asking for copies of the Credit agreements, neither were able to come back to me. So, they have each been passed to a number of DCA's which to be honest I go through the same process with each of them and get nowhere.

So, my question is, can unsecured debts be enforced while I live overseas? In all honesty, I would be happy to pay the debts back but not until I see the CA with my ex's signature too. I get a lot of threats from DCA's saying that they will take further action but I want to know whether they can do this given I live abroad? Also, when I receive these letters should I respond to them while they are not sending me the credit agreement copies?

    They can certainly obtain CCJs against you (both) in the UK courts by sending court papers to your last known UK address.

    They cannot enforce the CCJ against you unless the country in which you live has a reciprocal arrangement.

    well they can send them to my old UK address ut I rented an apartment and so will never get them. What are the chances they will come over here to enforce the debts?

    Depends on what country you live in as to whether they can enforce CCJs obtained in the UK where you live.
    Likely depends on the amounts of the debts as to what the chance is that they would try.

    What were the debts? were they all taken out in joint names or you and your partner? You say they were in your name but then say his name will be on the agreement?

    I live in Gibraltar - is there any way of knowing whether it is enforceable here? One debt is a credit card for 2.8k and one is a loan for about 5.5k...

    I thought they were jointly signed, but unfortunately not; all are in my name.

    I guess there is no way of claiming anything from him?
