    yes,so if the house was repossessed,with no profit,what happens to the unsecured loan,would they try and claim equity out of his sole house where he lives,my friend is unsure

    My understanding is as follows:

    there are two properties A and B

    the girl is living in B which has a mkortage is joint names

    the OP is not paying anything towards the mortgage or costs of Property B

    the mortgage is 2k in arrears

    they are both severally and jointly responsible for the mortgage on B
    I'm uncertain about the status of the 55k secured loan

    what is the value of the house?
    what is the mortgage?
    is the 55k in addition to the mortgage and is it in joint names?

    house A is in the OP sole name and has 20k equity


    what other debts are they and are they joint or not?

    As his friend remortgage his family home, the friend must be paying this money back on house A. The remortgage on the other house was being paid back by the girlfriend when she chucked him out, but she can no longer afford to do this, so she needs help with paying the mortgage and secured loan on the second house.

    Is he paying/planning to pay maintenance towards his child?

    Either way, if she does take him to court (has she? or just threatened to?), he needs a solicitor.

    Your question seems to be 'Can she take him to court?', to which the answer is 'yes, she can'. Whether she'll win is another matter.

    The law is applied differently for married couples and living together couples, as I'm sure you already know.
    What a minefield, don't envy you - legal advice is an absolute must.
