Civil Service Fixed Term Contracts

I had a fixed term contract as an EO at DWP until May this year. Obviously, in the run up to the expiration of my contract, I was doing some fairly intensive job searching. In the course of these searches, I applied for some internal vacancies with HMPS and MoJ. In terms of transferring on a FTC, it is fine so long as the individual has been recruited through fair and open competition, which I had. However, there seems to be some disagreement about transfer policies.
My manager said that so long as I got my application in before my contract ended, I was eligible to transfer. However, MoJ seemed to think that one can only be transferred if they are still in the civil service when the new post is due to begin.
Further complicating the matter, I now work for an organisation considered by some to be an NDPB, and not by others. NDPB staff appear to be eligible for some CS internal vacancies, and not others.
Does anybody know who's right in all of this? If it is the MoJ, surely that disadvantages FTCs immensely?

There is a very effective trade union in the civil service - the PCS. I would urge you to join and seek advice from them - they will have considerable experience of dealing with similar queries, which are specific to the civil service and the policies and procedures of the departments involved.0
