    Hi everyone,

    Just an update (or not really as it happens!) - no response from the creditor, it's been three weeks now, but had a letter from their DCA (I went to the original creditor direct to negotiate the F & F - wrote to the DCA to explain this) today asking me to call them. I'm sending them a copy of the last letter I sent to the OC, saying I've had no response, and I'm waiting for one before I settle the account (Is that a good idea to send a copy of the letter? Is it any of their business?). Also Payplan suggested freezing the DMP payments as the account was about to be settled but I'm going to ask them to keep on paying for now as this is going to drag on I think. I've mentioned that in the letter too and apologised for the delay in the payments.

    I'm going to give it another few days and then resend my letter to the OC too.

  • Well, I've heard back from the OC - it sounds like the DCA passed my letter onto them and told them I was waiting for a response -

    Dear xxxx,

    Further to your request to our authorised agents xxxx (DCA), please accept this letter as confirmation that upon receipt of the sum of £xxxx in settlement of the above credit card, xxxxx (original creditor) and/or xxxx (DCA) will take no further action against you.

    Please note this is subject to the terms of the settlement agreed between xxxx (DCA) and yourself.


    If you have any queries regarding the above please do not hesitate to contact me etc etc.


    The part in bold (my bold) refers to a F & F letter the DCA sent me (ironically perfectly worded just as I'd asked as per NDL template) after we'd agreed on a settlement figure a couple of months ago now, and it turned out that the original creditor had never authorised this amount which is why I had to start all over again with them direct! So the "terms agreed with xxxx and yourself" means nothing.

    There's still no sign of the words full and final. They've said neither they nor the DCA will chase me but what if they sell it on to someone else? I don't understand why it's so difficult just to put what I'm asking for in writing! Is this enough or should I write back again? I don't want to antagonise them but on the other hand I don't want to part with any money until the terms are much clearer. Has anyone else has this at all? I just want to get this paid and finished! Head is spinning!
