Bigoffers.co.uk netbook delivered NOT netbook ordered

I ordered a netbook from bigoffers.co.uk on 27th June. It arrived on 29th. However, it is a lesser model than the one I ordered (DDR2 and not DDR3 as advertised, lesser CPU).

I've contacted them twice in regard to this but still no reply.

Anyway, before I realised it was the wrong model, I had already opened the item...N.B. it wasn't clear that it was a different model – it had the same model number! Don't ask me why Acer make netbooks with different specs but the same model no. but they do!

The company has a strict 7 day return policy. I'm sure they will say 'Why did you open it..blah, blah?'. Obviously, given the timeframe, I'm anxious to get the item returned.

The website FAQ expressly says not to return an item without an RMA.

I bought the item on my credit card and so I suppose I could open a dispute. In the circumstances I would probably be able to get my money back but would hope it can be sorted out more amicably. I'd settle for a part refund or something.

I've read some horror stories on people returning items to this company...

Any useful advice would be much appreciated.

    7-day returns will only be for mind-changes and DSR returns - your return is for 'not as advertised'

    FWIW I've usually found their other company 'boffer' to be pretty good for customer service - a little slow maybe, but the intentions were usually pretty decent.

    I emailed last night and still no reply. Probably still a bit early to panic but I'd hope for answer by the end of Fri.

    Just got an email saying the site's closed til Mon night; if I have to return the item within 7 days I'll have to send it on Mon.

    The 7 days is only for a change of mind under the Distance selling regulations, and even then all it means is that you must simply inform the seller of your wish to cancel the contract within 7 working days (and this time starts the day following delivery).
    You don't have to return the goods within 7 days.

    However, as your goods are not what you ordered, you simply have to advise the seller of this and tell them whether you want a full refund or the correct item being sent to you, providing that they are available.
    The retailer is responsible for all the costs incurred in returning the unwanted item.

    They won't have the item in stock - I'm sure of that. Yes, I'd like a full refund but I want them to tell me I'll get it in the circumstances.

    But the OP is still entitled to return it anyway and use the DSRs.

    That's seven working days (not including Saturdays and Sundays), starting from the day after you received the goods.

    Yes you are right Flyboy... they could do that.

    However the OP would probably be better off using SOGA and 'not as described'.
    That is because savvy sellers spell out in 'the required documentation' that the buyer is responsible for the cost of return if returning under DSRs.

    OP, forget the DSRs, return under SOGA.

    Don't forget your right to initiate a chargeback against most card companies on the basis of being supplied the wrong product.

    I don't disagree with that at all, but there have been examples where retailers try to wriggle out of "misdescribed" goods and it might be the most expedient course of action. Lose five pounds to save three hundred. It's not ideal, but might be the best way out.
