hello, me and my partner have just found out he has been on tax code BR since sept 2009, i've read that BR is only if you have a second job which he doesn't. I know we have to get a P46 form which i've heard his employer has to provide, is that right? if so what happens after that.
I've heard that if he does it through his employer they will pay him back through his wages but will be tax on it again. Can we just call the tax office instead?

if he has only one job then BR is incorrect
he can phone the HMRC who can correct this years taxcode which will mean he will then pay the correct tax for this year.
however he will also need to reclaim the overpaid tax for tax year 200-2010 and for 2010-2011

he is owed 956 from 2009/10 and 1494 from 2010/11!!0

It doesn't have to be necessary a job that can cause BR, but also pension etc... However once you call HMRC about it they will tell you if there is a mistake.
The form P46 is available online for free, it's not like the employer MUST provide it for you to be able to complete it. But that should have been done when he started the job. If you call HMRC to sort it all out with them there is no need to complete it. HMRC will issue employer correct code after your conversation.
Yes, this years tax will be refunded through wages. And NO, it will NOT be taxed again. It will not come through as earnings, it will come through as tax refund. ie it will not be on the line "salary" or "basic", but where it says "tax" or "NI" there will be different figure, in this case possibly negative figure now.
Last tax years overpayment will be refunded by HMRC direct. They might ask to send in a copy of P60.0 -
